SIRI JAGAN, J.\n                 -----------------------------------\n                   W.P.(C) No.34228 OF 2010\n               ---------------------------------------\n          Dated this the 12th day of November, 2010\n\n                            JUDGMENT\n<\/pre>\n<p>     In this writ petition, the petitioners are drivers engaged on<\/p>\n<p>daily wages for driving vehicles of various Panchayats.       They<\/p>\n<p>have filed this writ petition apprehending termination from<\/p>\n<p>service. According to them, they are not liable to be terminated<\/p>\n<p>from service insofar as there are no sanctioned posts of drivers<\/p>\n<p>in the Panchayats and no rank list prepared by the Public Service<\/p>\n<p>Commission for such appointment is in force. Therefore, they<\/p>\n<p>seek a direction to the respective Panchayat in which they are<\/p>\n<p>working   to continue them in service until a regular hand is<\/p>\n<p>appointed to the post.\n<\/p>\n<p>     2.   I have heard the learned Government Pleader also.<\/p>\n<p>     3.   None of the petitioners have any case that they were<\/p>\n<p>engaged as temporary drivers on daily wages after undergoing a<\/p>\n<p>selection process either through the employment exchange or by<\/p>\n<p>issuing notification inviting applications for such appointments. I<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.34228\/10                2<\/span><\/p>\n<p>am of opinion that insofar as there may be other candidates<\/p>\n<p>who are also eligible to be considered for such temporary<\/p>\n<p>appointment who were not given opportunity to apply for the<\/p>\n<p>post on account of the fact that no applications have been<\/p>\n<p>invited either through employment exchange or by inviting<\/p>\n<p>applications by public notice, such engagement of the<\/p>\n<p>petitioners without a selection process known to law, would<\/p>\n<p>violate the fundamental rights of those persons under Articles<\/p>\n<p>14 and 16 of Constitution of India.                For all public<\/p>\n<p>employments, even if temporary, all persons who are eligible<\/p>\n<p>to be considered should be given a chance for participating in<\/p>\n<p>the selection process.     As such, it would be violative of the<\/p>\n<p>fundamental rights of those persons to allow the petitioners to<\/p>\n<p>continue in service insofar as      they have not been selected<\/p>\n<p>after a selection process giving opportunity to others also to<\/p>\n<p>compete for selection to the post. In the above circumstances,<\/p>\n<p>this writ petition is disposed of with the following directions:<\/p>\n<p>      The concerned Panchayats, if they wish to engage drivers<\/p>\n<p>on temporary basis on daily wages to drive any of their<\/p>\n<p>vehicles, shall conduct a selection      for such appointments,<\/p>\n<p>after inviting applications from all who intend to apply for the<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.34228\/10                3<\/span><\/p>\n<p>said engagement by a selection process known to law and<\/p>\n<p>complete the process of selection and appointment as<\/p>\n<p>expeditiously as possible, at any rate, within two months from<\/p>\n<p>the date of receipt of a copy of this judgment. Only persons so<\/p>\n<p>selected shall be allowed to occupy the post. The petitioners<\/p>\n<p>shall be allowed to continue in service for a period of two<\/p>\n<p>months. The petitioners shall also be allowed to apply in the<\/p>\n<p>selection process and their candidature shall also be<\/p>\n<p>considered along with those of other applicants who apply.<\/p>\n<p>However, in cases where any of the petitioners in this writ<\/p>\n<p>petition have been appointed as temporary drivers on daily<\/p>\n<p>wages, after conducting a selection process known to law viz.<\/p>\n<p>after inviting applications from the public and making a<\/p>\n<p>selection from applicants, the above direction shall not be<\/p>\n<p>applicable in those cases and they shall be allowed to continue<\/p>\n<p>in service until a regular hand is appointed after sanction of<\/p>\n<p>the post of driver or the Panchayat continues to require the<\/p>\n<p>service of the petitioners.\n<\/p>\n<\/p>\n<p>                                     S.
