No.3420 of 2010\n                 ................................................\n        Dated this the 1st day of December, 2010.\n\n                                 O R D E R\n<\/pre>\n<p>      In this Revision Petition filed under Section 397 read with<\/p>\n<p>Sec. 401 Cr.P.C. the petitioner who was the accused in S.T. No.<\/p>\n<p>2737 of 2007 on the file of the Judicial First Class Magistrate,<\/p>\n<p>Nilambur challenges        the conviction         entered and the sentence<\/p>\n<p>passed against him for an offence punishable under Sec. 138 of<\/p>\n<p>the Negotiable Instruments Act, 1881 (hereinafter referred to as<\/p>\n<p>&#8216;the Act&#8217;). The    cheque        amount        was      `1,00,000\/-.  The<\/p>\n<p>fine\/compensation ordered by the lower appellate court is<\/p>\n<p>`1,00,000\/-.\n<\/p>\n<p>      2.    I heard the learned counsel for the Revision Petitioner<\/p>\n<p>and the learned Public Prosecutor.\n<\/p>\n<p>      3.    The learned counsel appearing for the Revision<\/p>\n<p>Petitioner re-iterated the contentions in support of the Revision.<\/p>\n<p>      4.     The courts below have concurrently held that the<\/p>\n<p>cheque in question was drawn by the petitioner in favour of the<\/p>\n<p>complainant, that the complainant had validly complied with<\/p>\n<p>clauses (a) and (b) of the proviso to Section 138 of the Act.         and<\/p>\n<p>that the Revision Petitioner\/accused failed to make the payment<\/p>\n<p><span class=\"hidden_text\">Crl.R.P. No. 3420\/2010             : 2 :<\/span><\/p>\n<p>within 15 days of receipt of the statutory notice.    Both the courts<\/p>\n<p>have considered and rejected the defence set up by the revision<\/p>\n<p>petitioner while entering the conviction. The said conviction has<\/p>\n<p>been recorded         after a careful evaluation    of the oral and<\/p>\n<p>documentary evidence. This Court sitting in the rarefied revisional<\/p>\n<p>jurisdiction will be loath to interfere with the findings of fact<\/p>\n<p>recorded by the Courts below concurrently.         I do not find any<\/p>\n<p>error, illegality or impropriety in the conviction       so recorded<\/p>\n<p>concurrently by the courts below and the same is hereby<\/p>\n<p>confirmed.\n<\/p>\n<p>      5.       What now survives for consideration is the legality of<\/p>\n<p>the sentence imposed on the revision petitioner.      No doubt, now<\/p>\n<p>after the decision of the Apex Court in <a href=\"\/doc\/1806949\/\">Vijayan v. Sadanandan<\/p>\n<p>K. and Another<\/a> (2009) 6 SCC 652 it is permissible for the<\/p>\n<p>Court       to slap    a default sentence   of imprisonment     while<\/p>\n<p>awarding compensation under Sec. 357 (3) Cr.P.C.         But, in that<\/p>\n<p>event, a sentence of imprisonment will be inevitable.           I am,<\/p>\n<p>however, of the view that in the facts and circumstances of this<\/p>\n<p>case     a sentence of fine with an appropriate default sentence<\/p>\n<p>will suffice.     Accordingly, for the conviction under Section 138 of<\/p>\n<p>the Act the revision petitioner is sentenced to pay a fine of<\/p>\n<p>`1,05,000\/- (Rupees one lakh and five thousand only).             The<\/p>\n<p><span class=\"hidden_text\">Crl.R.P. No. 3420\/2010           : 3 :<\/span><\/p>\n<p>said fine shall be paid as compensation under Section 357 (1)<\/p>\n<p>Cr.P.C. The revision petitioner is permitted either to deposit the<\/p>\n<p>said fine amount before the Court below        or directly pay the<\/p>\n<p>compensation to the complainant within six months from today and<\/p>\n<p>produce a memo to that effect before the trial Court in case of<\/p>\n<p>direct payment. If he fails to deposit or pay the said amount<\/p>\n<p>within the aforementioned period        he shall suffer     simple<\/p>\n<p>imprisonment for three months by way of default sentence.<\/p>\n<p>      In the result, this Revision is disposed of confirming the<\/p>\n<p>conviction entered but modifying the sentence imposed on the<\/p>\n<p>revision petitioner.\n<\/p>\n<p>      Dated this the 1st day of December, 2010.\n<\/p>\n<\/p>\n<p>                                       V.
