    Plaintiff in O.S.170\/2002 on the file of<\/p>\n
Munsiff  Court,  Perumbavoor   who   is     the<\/p>\n
respondent in A.S.114\/2007, is the appellant.<\/p>\n
Second defendant and defendants 3 and 4 the<\/p>\n
other legal heirs of deceased first defendant<\/p>\n
who are the appellants in A.S.114\/2007 on the<\/p>\n
file  of   Sub  court,   Perumbavoor  are   the<\/p>\n
respondents.  Appellant instituted O.S.170\/2002<\/p>\n
claiming damages for defamation      originally<\/p>\n
from the first defendant and his first wife the<\/p>\n
first respondent.   On the death of the first<\/p>\n
defendant,  respondents  2  and  3   were  also<\/p>\n
impleaded as additional defendants.     Learned<\/p>\n
Munsiff granted a decree in favour of the<\/p>\n
appellant to realise Rs.50,000\/- as damages.<\/p>\n
It was challenged before Sub Court, Perumbavoor<\/p>\n
F.A.O.236\/2008               2<\/span><\/p>\n
in A.S.114\/2007.      Learned Sub Judge   after hearing<\/p>\n
the     appeal,   as   per  judgment   dated  16.2.2008<\/p>\n
remanded the suit to the trial court for fresh<\/p>\n
disposal      after   granting   opportunity   to   the<\/p>\n
respondents to adduce defence evidence.      The order<\/p>\n
of remand is challenged in this appeal.<\/p>\n
      2. The appeal was admitted on the following<\/p>\n
substantial question of law.<\/p>\n<\/p>\n
               Whether the order of<\/p>\n
            remand   by    the   first<\/p>\n
            appellate court is legal<\/p>\n
            when the appellants in the<\/p>\n
            first appeal have no case<\/p>\n
            that they were not granted<\/p>\n
            opportunity   to    adduce<\/p>\n
            evidence or were prevented<\/p>\n
            from adducing evidence.”\n<\/p>\n
      3.       Learned   counsel   appearing  for  the<\/p>\n
appellant and respondents were heard.<\/p>\n
      4.     The suit was for damages contending that<\/p>\n

the     defendants   by   filing  a  complaint   before<\/p>\n
Kunnathunad      Police registered as Crime No.144\/2001<\/p>\n
under section 324 of IPC caused damages to the<\/p>\n
reputation       of   the   appellant   by  committing<\/p>\n
defamation       and therefore he is entitled to get<\/p>\n
damages.       The suit was resisted by    respondents<\/p>\n
contending that Police has registered the case and<\/p>\n
there was justification for lodging the complaint<\/p>\n
and the reputation of the appellant            was not<\/p>\n
affected by the complaint and it is justified by<\/p>\n
truth and therefore the suit is not maintainable.<\/p>\n
      5. Before the trial court appellant and three<\/p>\n
witnesses were examined on his side and on the side<\/p>\n
of    the    respondent  first  respondent the   second<\/p>\n
defendant was examined and Exts.A1 to A6 were<\/p>\n
marked.       It is on that evidence, learned Munsiff<\/p>\n
granted a decree.       The learned Sub Judge did not<\/p>\n
analyse the evidence or found that     appreciation of<\/p>\n
evidence by the trial court was not proper.     On the<\/p>\n
other hand after narrating the arguments raised by<\/p>\n
F.A.O.236\/2008              4<\/span><\/p>\n
the appellants and respondents in the first appeal,<\/p>\n
the     learned   Sub  Judge  remanded the suit  as<\/p>\n
follows:-\n<\/p>\n
          “The   burden  is   on   the<\/p>\n
           defendant  to  prove   that<\/p>\n
           they   are   justified   in<\/p>\n
           filing the complaint.  The<\/p>\n
           defendant  did  not  adduce<\/p>\n
           evidence  to   prove   this<\/p>\n
           aspect.    Therefore,   the<\/p>\n
           counsel      wants       an<\/p>\n
           opportunity  for   adducing<\/p>\n
           fresh evidence.  It can be<\/p>\n
           seen   that    the    first<\/p>\n
           defendant is no more.  The<\/p>\n
           2nd defendant  is  a  widow<\/p>\n
           with  two  minor  children.<\/p>\n
           Considering this aspect it<\/p>\n
           is   necessary   that   the<\/p>\n
           defendant should be given<\/p>\n
F.A.O.236\/2008               5<\/span><\/p>\n
           an  opportunity  to  adduce<\/p>\n
           evidence  regarding   their<\/p>\n
           defence.    Therefore,  the<\/p>\n
           judgment and decree of the<\/p>\n
           lower court is set aside.”<\/p>\n<\/blockquote>\n
Learned counsel appearing for the appellant made<\/p>\n
available      copy of the appeal memorandum.   It is<\/p>\n
seen from the appeal memorandum that there was no<\/p>\n
case for the respondents in the appeal that they<\/p>\n
were not granted sufficient opportunity to adduce<\/p>\n
evidence.      There is also no case that any of the<\/p>\n
witnesses who were sought to be examined could not<\/p>\n
be examined for any reason.       There was no prayer<\/p>\n
for a remand of the suit for adducing further<\/p>\n
evidence.     Learned Sub Judge also did not find that<\/p>\n
the appellants in the first appeal were prevented<\/p>\n
from adducing necessary evidence either by an act<\/p>\n
of the trial court or for any other reason.         In<\/p>\n
such     circumstance,   learned  Sub Judge  was  not<\/p>\n
justified in setting aside the decree and judgment<\/p>\n
F.A.O.236\/2008              6<\/span><\/p>\n
of the trial court and remanding        the suit for<\/p>\n
granting an opportunity to the defendants to adduce<\/p>\n
evidence      without  considering  the  evidence  on<\/p>\n
record.       It is more so when even the defendants<\/p>\n
themselves have no case that they did not get<\/p>\n
opportunity to adduce evidence.<\/p>\n
      In such circumstance, appeal is allowed. The<\/p>\n
judgment       in   A.S.114\/2007   is    set   aside.<\/p>\n
A.S.114\/2007 is remanded to     Sub Court, Perumbavoor<\/p>\n
for fresh disposal in accordance with law.    Learned<\/p>\n
Sub Judge       to hear the appeal and dispose    the<\/p>\n
appeal on merits.      Parties are directed to appear<\/p>\n
before the Sub Court, Perumbavoor on 26.5.2009.<\/p>\n
