HANSARIA, J.- The Central Administrative Tribunal,\t New<br \/>\nBombay\tBench, was approached by the respondent seeking\t two<br \/>\ndeclarations  in the main that he voluntarily  retired\tfrom<br \/>\nservice with effect from 22-10-1985 and that all proceedings<br \/>\nagainst him pending as on that date were of no\tconsequence.<br \/>\nThe Tribunal after having applied mind to the charges, which<br \/>\non  inquiry were found established, came to  the  conclusion<br \/>\nthat  the  respondent had been rightly found guilty  of\t the<br \/>\ncharges, but it set aside the order of removal passed by the<br \/>\nappellate  authority, who on appeal being preferred  by\t the<br \/>\nrespondent had awarded this punishment instead of dismissal,<br \/>\nwhich  was  the\t punishment inflicted  by  the\tdisciplinary<br \/>\nauthority.  This order of the Tribunal has been assailed  in<br \/>\nthis appeal.\n<\/p>\n<p>2.   The  Tribunal had taken the aforesaid view because\t the<br \/>\nrespondent  had\t by a letter dated 22-7-1985 given  a  three<br \/>\nmonths&#8217;\t notice\t to the Railways to retire from\t service  as<br \/>\nvisualised by Rule 1802(b) of Indian Railways  Establishment<br \/>\nCode.  The period of three months had expired on  21-10-1985<br \/>\nand the order of removal was first passed on 4-11-1985.\t  It<br \/>\nwas  held by the Tribunal that the respondent  was  entitled<br \/>\nunder the law to seek premature retirement; and,  therefore,<br \/>\nthe order of removal has to be treated as non est in the eye<br \/>\nof law.\n<\/p>\n<p>3.   The  learned Additional Solicitor General,\t Shri  Ahmed<br \/>\nappearing  for the appellants, has contended that the  right<br \/>\nof premature retirement conferred by the aforesaid provision<br \/>\ncould  be  denied to a railway servant in case he  be  under<br \/>\nsuspension,  as\t was the respondent at\tthe  relevant  time.<br \/>\nThis  is  what finds place in the proviso to  the  aforesaid<br \/>\nprovision.  The Additional Solicitor General also<br \/>\n+ From the Judgment and Order dated 22-8-1991 of the Central<br \/>\nAdministrative Tribunal, Bombay in O.A. No. 106 of 1987<br \/>\n<span class=\"hidden_text\">77<\/span><br \/>\nseeks  to  place reliance on what has been  stated  in\tRule<br \/>\n1801(d)\t which\tstarts with non-obstante clause\t and  states<br \/>\nthat  the competent authority may require a railway  servant<br \/>\nunder suspension to continue his service beyond the date  of<br \/>\nhis  retirement in which case he shall not be  permitted  by<br \/>\nthat authority to retire from service and shall be  retained<br \/>\nin  service  till such time as required by  that  authority.<br \/>\nRelying on these provisions the contention advanced is\tthat<br \/>\nthough the respondent had sought premature retirement by his<br \/>\nletter\tdated 22-7-1985 and though the three months&#8217;  period<br \/>\nhad  expired  on 21-10-1985, the Railways  were\t within\t the<br \/>\nrights not to permit the premature retirement because of the<br \/>\nsuspension of the respondent at the relevant time, which had<br \/>\ncome  to  be  ordered  in  the\tcourse\tof  a\tdisciplinary<br \/>\nproceeding which was then pending against the respondent.\n<\/p>\n<p>4.There\t are two answers to this submission.  The  first  is<br \/>\nthat both the provisions relied upon by the learned  counsel<br \/>\nwould  require,\t according  to us,  passing  of\t appropriate<br \/>\norder,\twhen the government servant is under suspension\t (as<br \/>\nwas  the  respondent), either of withholding  permission  to<br \/>\nretire\tor retaining of the incumbent in service.  It is  an<br \/>\nadmitted  fact\tthat no such order had been  passed  in\t the<br \/>\npresent\t  case.\t  So,  despite\tthe  right  given   to\t the<br \/>\nappropriate\/competent authority in this regard, the same  is<br \/>\nof no avail in the present case as the right had not come to<br \/>\nbe  exercised.\tWe do not know the reason(s)  thereof.\t May<br \/>\nbe, for some reason the authority concerned thought that  it<br \/>\nwould be better to see off the respondent by allowing him to<br \/>\nretire.\n<\/p>\n<p>5.The  second aspect of the matter is that it has been\theld<br \/>\nby  a  three-Judge  Bench of this Court\t in  <a href=\"\/doc\/1505986\/\">Dinesh  Chandra<br \/>\nSangma\tv.  State of Assam<\/a> 1, which has dealt  with  a\tpari<br \/>\nmateria\t provision  finding  place  in\tRule  56(c)  of\t the<br \/>\nFundamental  Rules, that where the government servant  seeks<br \/>\npremature   retirement\tthe  same  does\t not   require\t any<br \/>\nacceptance  and comes into effect on the completion  of\t the<br \/>\nnotice period.\tThis decision was followed by another three-<br \/>\nJudge Bench in B.J. Shelat v.
