Justice KURIAN JOSEPH\n\n Dated :29\/09\/2008\n\n O R D E R\n                           KURIAN JOSEPH, J.\n               ---------------------------------------\n                     W.P.(C) No.6999 OF 2006\n               ---------------------------------------\n         Dated this the 29th day of September, 2008.\n\n\n                             J U D G M E N T\n<\/pre>\n<p>     This writ petition is filed with the following prayers:<\/p>\n<p>     a)    Issue a writ of mandamus or other appropriate writ,<\/p>\n<p>           order or direction commanding the 1st respondent to<\/p>\n<p>           take immediate steps to implement the Government<\/p>\n<p>           orders Ext.P2 to 4 in its true spirit in the coming financial<\/p>\n<p>           year itself i.e. 2006-2007.\n<\/p>\n<p>     b)    Issue a writ of mandamus or other appropriate writ,<\/p>\n<p>           order or direction commanding the 1st respondent to<\/p>\n<p>           take effective steps to ensure that all Local Level<\/p>\n<p>           Committees in the State constituted as per the<\/p>\n<p>           provisions of the National Trust for Welfare of Persons<\/p>\n<p>           with Autism, Cerebral Palsy, Mental Retardation and<\/p>\n<p>           Multiple Disabilities Act, 1999 function properly.<\/p>\n<p>     c)    Issue a writ of mandamus or other appropriate writ,<\/p>\n<p>           order or direction commanding the 2nd respondent to<\/p>\n<p>           ensure that all the Grama Panchayaths in the Kottayam<\/p>\n<p>           District to monitor the utilization of the plan fund by the<\/p>\n<p>           Local   Self    Government    Bodies     and   ensure   that<\/p>\n<p>           scholarship and allowance are paid to the school going<\/p>\n<p>           mentally retarded persons in the District.<\/p>\n<p>     It is seen from the counter affidavit that the panchayaths in<\/p>\n<p>Kottayam District set apart 5% of their annual budget plan fund<\/p>\n<p>for the welfare of the disabled, children and old persons and a<\/p>\n<p>further 10% of the plan fund for women.<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.6999\/06                 2<\/span><\/p>\n<p>       2. In case any panchayath has not utilized the amount thus<\/p>\n<p>set apart for the welfare of the weaker sections, it will be open to<\/p>\n<p>the petitioner to point out the same before the second<\/p>\n<p>respondent, in which case, the second respondent\/Ombudsman<\/p>\n<p>for Local Self Government Institutions shall take prompt action in<\/p>\n<p>accordance with law in the matter, expeditiously.
