SHAH<\/p>\n<p>and<\/p>\n<p>HONOURABLE<br \/>\n\t\t\tMR.JUSTICE K.A.PUJ<\/p>\n<p>Date<br \/>\n: 23\/10\/2008<br \/>\nCAV ORDER <\/p>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE K.A.PUJ)<\/p>\n<p>\tThe applicant has<br \/>\n\tfiled this application under Section 5 of the Limitation Act for<br \/>\n\tcondonation of delay of 1568 days caused in filing appeal.\n<\/p>\n<p>\tRule was issued by<br \/>\n\tthis Court on 12.04.2007.\n<\/p>\n<p>Heard<br \/>\n\tthe learned counsels appearing for the parties.  Perused the<br \/>\n\tpleadings.\n<\/p>\n<p>OJ<br \/>\n\tAppeal Stamp No.3420 of 2006 is preferred challenging the judgment<br \/>\n\tand order dated 30.07.2002 of the learned Company Judge passed in<br \/>\n\tCompany Application No.268 of 1994 whereby the learned Company Judge<br \/>\n\trejected the claim of the leasehold right of the applicant and held<br \/>\n\tthat the lease was a long term lease and the leasehold rights over<br \/>\n\tthe land of the Company in winding up is the assets of the Company<br \/>\n\twhich was put up for sale by the Official Liquidator.\n<\/p>\n<p>Against<br \/>\n\tthe said order dated 30.07.2002 of the learned Company Judge,<br \/>\n\tvarious Appeals were filed before this Court.  The contention raised<br \/>\n\ton behalf of the lessors herein were also raised in OJ Appeal Nos.<br \/>\n\t65 to 67 of 2006.  By our judgment dated 17.10.2008, we have<br \/>\n\trejected this contention and dismissed the appeals of the lessors.\n<\/p>\n<p>Following<br \/>\n\tthe aforesaid decision, the present appeal also deserves to be<br \/>\n\tdismissed.  In view of the above, delay of 1568 days is not required<br \/>\n\tto be condoned as the issue involved in the appeal is fully covered<br \/>\n\tby this Court and a judgment to this effect was delivered by this<br \/>\n\tCourt on 17.10.2008.\n<\/p>\n<p>In<br \/>\n\tthe above view of the matter, present Civil Application is rejected.<br \/>\n\t Notice discharged.\n<\/p>\n<p>In<br \/>\n\tview of dismissal of Civil Application, OJ Appeal Stamp Number 3420<br \/>\n\tof 2006 and Civil Application (Stamp Number) No.3422 of 2006 do not<br \/>\n\tsurvive and they are accordingly disposed of.\n<\/p>\n<p>\t\t\t\t\t\t\t\t[M.
