PARTY.\n                                            -----------\n<\/pre>\n<p>             For the petitioner : Mr. Gagandeo Yadav, Adv .<br \/>\n                For the State : Mr. Binod Kumar, A.P.P.<\/p>\n<p>2\/   16.06.2010               Heard the parties.\n<\/p>\n<p>                              In a criminal prosecution for offences under<\/p>\n<p>                  sections 307\/34 and some other allied sections of the<\/p>\n<p>                  Indian Penal Code, both the petitioners are specifically<\/p>\n<p>                  named in the F.I.R. as accused. According to the F.I.R. vide<\/p>\n<p>                  Annexure-1,     petitioner no.1 is alleged to have assaulted<\/p>\n<p>                  the informant by farsa and lathi on his head, causing<\/p>\n<p>                  injury to him. Petitioner no.2 is said to have assaulted<\/p>\n<p>                  Kalicharan Thakur and Kashi Nath Thakur by lathi and<\/p>\n<p>                  danda on his head, as a result of which they sustained<\/p>\n<p>                  injuries.\n<\/p>\n<p>                              Learned counsel for the petitioners submits that<\/p>\n<p>                  there is case and counter case from both sides and injuries<\/p>\n<p>                  sustained by the injured persons were found to be simple<\/p>\n<p>                  in nature by the doctor of Primary Health Centre,<\/p>\n<p>                  Madhepur.\n<\/p>\n<p>                              However, from perusal of the impugned order<\/p>\n<p>                  passed by the learned Sessions Court, it appears that all<\/p>\n<p>                  the three injured persons were referred to D.M.C.H. for<br \/>\n<span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>           further treatment and the doctors of D.M.C.H. reported<\/p>\n<p>           that they have sustained grievous injuries on their<\/p>\n<p>           persons.
