Justice S.SIRI JAGAN\n\n Dated :28\/10\/2009\n\n O R D E R\n                              S.SIRI JAGAN, J.\n                       ==================\n                        W.P(C).No.28788 of 2009\n                       ==================\n                Dated this the 28th day of October, 2009\n                              J U D G M E N T\n<\/pre>\n<p>       This writ petition is respect of a dispute between the Bharat<\/p>\n<p>Sanchar Nigam Ltd. and the Kerala State Electricity Board, two<\/p>\n<p>Government entities, one owned by the Government of India and the<\/p>\n<p>other by the State of Kerala.        The Supreme Court has held that<\/p>\n<p>disputes between Government entities shall not be dragged to courts<\/p>\n<p>and the same shall be resolved by a high power committee appointed<\/p>\n<p>by the Government for the purpose. In fact, consequent to a direction<\/p>\n<p>of the Division Bench of this Court, certain other disputes between the<\/p>\n<p>same parties have been referred to a high power committee<\/p>\n<p>constituted for that purpose. In the above circumstances, I am of<\/p>\n<p>opinion that the dispute in this writ petition should also be resolved by<\/p>\n<p>that high power committee. Accordingly, the very same high power<\/p>\n<p>committee which has been constituted as per the direction of the<\/p>\n<p>Division Bench of this Court, shall consider the dispute involved in this<\/p>\n<p>writ petition also, for which purpose, the 1st respondent shall, by<\/p>\n<p>addressing the Government, take appropriate steps in the matter.
