Dubey\n                          -----\n\n13\/04.05.2010<\/pre>\n<p>      Heard the parties.\n<\/p>\n<p>                   By this application, filed under Section 11 (6) of the<br \/>\n            Arbitration &amp; Conciliation Act, 1996, prayer has been made for<br \/>\n            appointment of an arbitrator for settlement of disputes and claims<br \/>\n            raised by the petitioner. It appears that pursuant to tender invited by<br \/>\n            the respondents, for construction of Pathargaria, Kermodih and<br \/>\n            adjoining village water supply scheme consisting construction of<br \/>\n            intake well, settling tank, Pressure filter etc., the petitioner was<br \/>\n            awarded the contract.\n<\/p>\n<p>                   The petitioner&#8217;s case is that although contract was awarded<br \/>\n            in 2003 but the drawing was not made available as a result work<br \/>\n            could not be done. Subsequently the work was executed and as<br \/>\n            per the direction of the respondents some additional work was also<br \/>\n            executed. The dispute arose between the parties with regard to<br \/>\n            payment of bills etc. The petitioner accordingly requested the<br \/>\n            respondents to get the matter settled through the mode of<br \/>\n            arbitration which exceeded to this application.\n<\/p>\n<p>                   A counter affidavit has been filed wherein existence of the<br \/>\n            agreement of the arbitration agreement has not been denied or<br \/>\n            disputed by the respondents. In paragraph 6 of the counter<br \/>\n            affidavit, it is stated that according to Clause 10 of the Work Order<br \/>\n            in case of any dispute the discretion of          Drinking Water and<br \/>\n            Sanitation Department, Government of Jharkhand shall be final and<br \/>\n            binding upon the parties concerned. However, it is disputed that as<br \/>\n            per the Work Order there was no escalation clause. Hence, the<br \/>\n            question of payment of cost does not arise. Lastly, it is stated that<br \/>\n            the application relating to claim of the petitioner was forwarded to<br \/>\n            higher authorities for necessary action.\n<\/p>\n<p>                  As noticed above, the existence of agreement, arbitration<br \/>\n           clause contain therein and the question of limitation has not been<br \/>\n           denied or disputes by the respondents. The only defence taken is<br \/>\n           that as per the agreement the petitioner is not entitled to any further<br \/>\n           claim. Hence, in my opinion, it is a fit case to be referred to the<br \/>\n           arbitrator. It appears from the pleading of the parties that the claim<br \/>\n           of the petitioner was forwarded to the Chief Engineer, Drinking<br \/>\n           Water and Sanitation Department, Government of Jharkhand for<br \/>\n           final decision.\n<\/p>\n<p>                  Hence, this application is allowed and the Chief Engineer,<br \/>\n           Drinking Water and Sanitation Department, Government of<br \/>\n           Jharkhand is directed to adjudicate the claim of the petitioner and<br \/>\n           take a decision by passing an award within a period of four months<br \/>\n           from the date of entering into the reference.\n<\/p>\n<p>                                                             (M.
