No.10500 of 2010\n                                        SURESH SAH\n                                            Versus\n                                  THE STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>05.   22.09.2010             Petitioner   is   languishing     in   jail   since<\/p>\n<p>                   03.11.2009 in a case registered under Sections 364,<\/p>\n<p>                   302, 201\/34 of the I.P.C.\n<\/p>\n<p>                             The petitioner is named in the F.I.R.             The<\/p>\n<p>                   case was instituted in 2000 whereas the petitioner<\/p>\n<p>                   surrendered after nine years.\n<\/p>\n<p>                             It   is   submitted   that   it   is   a   case    of<\/p>\n<p>                   circumstantial evidence in which other similarly<\/p>\n<p>                   situated accused persons have been granted bail.<\/p>\n<p>                             Considering the fact that petitioner has<\/p>\n<p>                   surrendered after nine years of the institution of the<\/p>\n<p>                   case, when he has been charge-sheeted and declared<\/p>\n<p>                   absconder by the police, on that ground alone, I am<\/p>\n<p>                   not inclined to grant bail to the petitioner at present.<\/p>\n<p>                   The application for grant of bail of the petitioner<\/p>\n<p>                   stands rejected in connection with Dhamdaha P.S.<\/p>\n<p>                   Case No. 19 of 2000.\n<\/p>\n<\/p>\n<p>                                               ( Dinesh Kumar Singh, J.)<br \/>\nShageer\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Suresh Sah vs The State Of Bihar on 22 September, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
