JUSTICE J.B.PARDIWALA)<\/p>\n<p>\tBy<br \/>\nway of this petition under Article 226 of the Constitution,<br \/>\npetitioner has prayed for the following reliefs:-\n<\/p>\n<p>(A)\tBe<br \/>\npleased to direct respondents Nos. 1 to 3 to initiate, conduct and<br \/>\nprosecute action in furtherance to the petitioner&#8217;s complaint dated<br \/>\n17.6.2004 against respondent No.4, the erring Judicial Officer;\n<\/p>\n<p>(B)\tPending<br \/>\nadmission, hearing and till final disposal of the present petition,<br \/>\nbe pleased to grant ad-interim relief in terms of para 15(A) above;\n<\/p>\n<p>(C)\tTo<br \/>\naward the costs of the present petition;\n<\/p>\n<p>(D)\tTo<br \/>\ngrant such other and further reliefs as may be deemed fit, just and<br \/>\nproper in the facts and circumstances of the case, in the interest of<br \/>\njustice and equity;\n<\/p>\n<p>2.\tIt<br \/>\nappears from the averments made in the petition that respondent No.4,<br \/>\na Judicial Officer of the rank of Civil Judge, decided Regular Civil<br \/>\nSuit No. 83 of 2002 preferred by the petitioner herein as plaintiff.<br \/>\nRespondent No.4 vide judgment and order dated 6th Feb. 2004,<br \/>\ndismissed the Civil Suit preferred by the petitioner herein.  It also<br \/>\nappears that against the said judgment, order and decree passed by<br \/>\nrespondent No.4, an appeal was preferred before the District Court,<br \/>\nwhich came to be allowed, in which some observations have been made<br \/>\nas regards the manner in which the whole Suit was conducted and<br \/>\ndecided.\n<\/p>\n<p>3.\tMaking<br \/>\nthis as the base, petitioner wants this Court to initiate appropriate<br \/>\nenquiry or action against respondent No.4 Judicial Officer.\n<\/p>\n<p>4.\tIt<br \/>\nis brought to our notice that this entire issue was taken into<br \/>\nconsideration by the High Court on its administrative side and after<br \/>\ndue enquiry in this regard, it was found that no action is necessary<br \/>\nto be initiated against respondent No.4.\n<\/p>\n<p>5.\tAs<br \/>\nthe issue has been looked into by the High Court on its<br \/>\nadministrative side, we do not propose to go into all these questions<br \/>\nraised in the writ petition.  In this view of the matter, we do not<br \/>\nfind any merit in the petition and the same is hereby ordered to be<br \/>\nrejected with no order as to costs.\n<\/p>\n<p>\t\t\t\t\t\t(A.L.\n<\/p>\n<p>Dave, Actg.
