In pursuance of the said impugned order, the<br \/>\npetitioner is detained in jail, Junagadh on 9.9.2009.\n<\/p>\n<p>3.\t\tAlong<br \/>\nwith the detention order, the petitioner detenu has been supplied<br \/>\nwith the grounds of detention. From the grounds of detention, it<br \/>\nappears that solitary offence being Prohibition CR No.5216 of 2009<br \/>\nhas been registered against the detenu.  The said offence has been<br \/>\nregistered with Ramol Police Station under the provisions of Sections<br \/>\n 65E, 81 and 116-B of the Bombay Prohibition Act wherein total<br \/>\nquantity of 60 bottles of foreign liquor was found from the<br \/>\npossession of the detenue. On the basis of registration of this case,<br \/>\nthe detaining authority held that the present detenue was carrying on<br \/>\nactivities of selling foreign liquor which is harmful to the health<br \/>\nof the public. It is held by the detaining authority that as the<br \/>\ndetenue is indulged in illegal activities, it is required to restrain<br \/>\nthe detenu from carrying out further illegal activities, i.e. selling<br \/>\nof liquor. The detaining authority has placed reliance on the above<br \/>\nregistered offence and statements of unnamed witnesses.  In the<br \/>\nopinion of this Court, the activities of the detenue can, by no<br \/>\nstretch of imagination, be said to be disturbing the  public<br \/>\norder.  It is seen from the grounds of detention that a general<br \/>\nstatement that has been made by the detaining authority that<br \/>\nconsuming liquor is injurious to health.  In fact, a perusal of the<br \/>\norder passed by the detaining authority shows that the grounds which<br \/>\nare mentioned in the order are in reference to the situation of  law<br \/>\nand order  and not  public order .  Therefore, on this ground,<br \/>\nthe subjective satisfaction arrived at by the detaining authority is<br \/>\nvitiated on account of non-application of mind and the impugned<br \/>\norder, therefore, deserves to be quashed and set aside.\n<\/p>\n<p>4.\t\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenue is carrying on<br \/>\nactivities of selling foreign liquor which is harmful to the health<br \/>\nof the public. In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai Solanki<br \/>\nv. Police Commissioner, Surat<\/a> [(2001)(1)GLH 393)], having<br \/>\nconsidered the decision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\nManohar Lohia v. State of Bihar (AIR 1966 SC 740), this Court<br \/>\nheld that the cases wherein the detention order passed on the basis<br \/>\nof the statements of the witnesses falls under the maintenance of<br \/>\n law and order  and not  public order .\n<\/p>\n<p>5.\t\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention  of a detenue, the detaining authority must come<br \/>\nto a definite finding that there is threat to the  public  order<br \/>\nand it is very clear that the present would not fall within the<br \/>\ncategory of threat to  public order . In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>6.\t\tThe<br \/>\npetition is allowed. The impugned order of detention dated 9.9.2009<br \/>\npassed against the detenu is hereby quashed and set aside. The detenu<br \/>\nis ordered to be set at liberty forthwith, if not required in any<br \/>\nother case. Rule is made absolute accordingly.
