SHAH\n\t\t\n\t\n\n \n\nDate\n: 20\/06\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\tBy way of this<br \/>\npetition under Article 227 of the Constitution of India, petitioner<br \/>\nhas prayed for an appropriate order to quash and set aside the<br \/>\nimpugned order dated 17\/03\/2011 by the learned Chamber Judge, City<br \/>\nCivil Court, Ahmedabad below Exh.8 in Summary Suit No.1220\/2010 by<br \/>\nwhich the learned Judge has granted unconditional leave to defend the<br \/>\nsuit to the respondents &#8211; original defendants.\n<\/p>\n<p>2.\tPetitioner<br \/>\nherein &#8211; original plaintiff has instituted Civil Suit<br \/>\nNo.1220\/2010 in the City Civil Court, Ahmedabad under Order 37 of the<br \/>\nCode of Civil Procedure to recover the amount which is deposited by<br \/>\nthe petitioner &#8211; original plaintiff which is alleged to have<br \/>\nbeen misappropriated by the agent of the postal department.  It is<br \/>\nthe case on behalf of the petitioner &#8211; plaintiff that the agent<br \/>\nof the postal department, in collusion with the postal department,<br \/>\nhas misappropriated the amount.  Therefore, it is submitted that the<br \/>\nlearned Judge has committed an error in granting unconditional leave<br \/>\nto defend the suit to the defendants.\n<\/p>\n<p>3.\tHaving heard<br \/>\nShri Modi, learned advocate appearing on behalf of the petitioner &#8211;<br \/>\nplaintiff and considering the impugned order, it appears that no<br \/>\nillegality has been committed by the learned trial Court granting<br \/>\nunconditional leave to defend the suit to the defendants.  Whether<br \/>\nthe amount is misappropriated by the agent and\/or the amount has been<br \/>\nmisappropriated by the agent in collusion with the postal department<br \/>\nand\/or other officers, are all issues which are required to be<br \/>\nconsidered at the time of trial.  Considering the nature of<br \/>\ncontroversy and dispute in the suit, the learned trial Court has<br \/>\nrightly granted unconditional leave to the original defendants.
