JUSTICE BIRENDRA PRASAD VERMA\nORAL ORDER<\/pre>\n<p>(Per: HONOURABLE THE CHIEF JUSTICE)<br \/>\n<span class=\"hidden_text\"> 2         Patna High Court LPA No.1366 of 2011 (2) dt.23-09-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                2\/3<\/span><\/p>\n<p>2.   23-09-2011 Interlocutory Application No. 6673 of 2011:\n<\/p>\n<blockquote><p>                                    Delay of one day occurred in filing the Letters Patent<br \/>\n                   Appeal is condoned.\n<\/p><\/blockquote>\n<blockquote><p>                                    Interlocutory Application stands disposed of.<br \/>\n                   Letters Patent Appeal No.1366 of 2011:\n<\/p><\/blockquote>\n<blockquote><p>                                    Feeling aggrieved by the judgment and order dated<br \/>\n                   12th July 2011 passed by the learned single Judge in above<br \/>\n                   C.W.J.C. No. 3733 of 2011, the writ petitioner has preferred the<br \/>\n                   present Appeal under Clause 10 of the Letters Patent.\n<\/p><\/blockquote>\n<blockquote><p>                                    The appellant is a retired Junior Engineer. In above<br \/>\n                   C.W.J.C. No. 3733 of 2011, the appellant challenged the order<br \/>\n                   dated 30th December 2010 made by the Chief Engineer (Central) in<br \/>\n                   respect of grant of benefit of the Assured Career Progression<br \/>\n                   (A.C.P.) to the appellant. The Chief Engineer, considering the 5<br \/>\n                   punishments of \u201eCensure\u201f imposed upon the appellant from 1998<br \/>\n                   to 2008 and the effect thereof, has rejected the claim of the<br \/>\n                   appellant for A.C.P. The challenge to the said order before the<br \/>\n                   learned single Judge has failed. Therefore, the present Appeal.\n<\/p><\/blockquote>\n<blockquote><p>                                    The benefit of higher pay has been extended to the<br \/>\n                   Government servants under the Bihar State Employees Conditions<br \/>\n                   of Service (&#8220;Assured Career Progression Scheme&#8221;) Rules, 2003.<br \/>\n                   Sub-rule (5) of Rule 4 of the said Rules provides that benefit of<br \/>\n                   higher pay under the A.C.P. will be granted in the same manner as<br \/>\n                   promotion. The pre-requisites for promotion shall be complied<br \/>\n                   with for benefit of A.C.P. also.\n<\/p><\/blockquote>\n<blockquote><p>                                    The impugned order has been made in accordance<br \/>\n                   with the Explanation-II to Rule 14 of the Bihar Government<br \/>\n                   Servants (Classification, Control &amp; Appeal) Rules, 2005 to deny<br \/>\n                   the benefit of first A.C.P. to the appellant. We may note here that<br \/>\n                   the aforesaid Explanation-II has been added to the Rules under the<br \/>\n<span class=\"hidden_text\"> 3         Patna High Court LPA No.1366 of 2011 (2) dt.23-09-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                3\/3<\/span><\/p>\n<p>                   amendment Rules of 2010. The said explanation, therefore, could<br \/>\n                   not have been applied to the case of the appellant, who has retired<br \/>\n                   from service prior to the date of the amendment.\n<\/p><\/blockquote>\n<blockquote><p>                                    Nevertheless, we are of the opinion that considering<br \/>\n                   five \u201eCensure\u201f imposed upon the appellant over a period of 10<br \/>\n                   years from 1998 to 2008 the appellant cannot be said to be fit for<br \/>\n                   promotion to the higher post. Unless the appellant were fit for<br \/>\n                   promotion to the higher post he could not have been granted the<br \/>\n                   benefit of A.C.P.\n<\/p><\/blockquote>\n<blockquote><p>                                    In our opinion, though the reliance placed on above<br \/>\n                   referred Explanation-II inserted under the Bihar Government<br \/>\n                   Servants (Classification, Control &amp; Appeal) (Third Amendment)<br \/>\n                   Rules, 2010 is illegal and uncalled for; having regard to his service<br \/>\n                   record for 10 years preceding the date of retirement, the appellant<br \/>\n                   cannot be said to be fit for promotion. Consequently, the appellant<br \/>\n                   cannot be granted the benefit of A.C.P.\n<\/p><\/blockquote>\n<blockquote><p>                                    For the reasons recorded hereinabove, the Appeal is<br \/>\n                   dismissed in limine.<\/p><\/blockquote>\n<p>                                                  (R.M.
