     1.           Heard learned counsel Shri V.D. Hon<\/p>\n
     for the petitioner, Shri S.K. Kadam, A.G.P. for<\/p>\n
     respondent Nos. 1 to 4.\n<\/p>\n
     2.             The     petitioner           in       present        Writ<\/p>\n
     Petition, impugns communication dated 07\/12\/2009<\/p>\n
     issued by the Commissioner for Co-operation and<\/p>\n
     the Registrar, Co-operative Societies, M.S., Pune<\/p>\n
     addressed    to      District       Deputy       Registrar,           Co-\n<\/p>\n
     operative     Societies,            regarding          implementing<\/p>\n
     Vaidyanathan Committee Report.\n<\/p>\n
     3.          The      Petitioner        is        a     Co-operative<\/p>\n
     Society     registered     under        the          provisions        of<\/p>\n
     Maharashtra Co-operative Societies Act, 1960, and<\/p>\n
     is a supervising unit concerned with the cadre of<\/p>\n
     the Secretaries constituted U\/Sec. 69-A of the<\/p>\n
     Societies Act. According to the petitioner its<\/p>\n
     area of operation extends to Jalgaon District.\n<\/p>\n

     The Petitioner society has been constituted with<\/p>\n
     the object of creating and maintaining the cadre<\/p>\n
     of Secretaries, Managers and other paid employees<\/p>\n
     of     Primary     agricultural       credit          and\/or          multi<\/p>\n
     purpose     co-operative         societies         and      also       such<\/p>\n
     other class of societies as may be permitted by<\/p>\n
     the State Government from time to time. According<\/p>\n
     to the petitioner it is functioning in accordance<\/p>\n
     with the provisions of Societies Act, Rules and<\/p>\n
     bye laws, which are duly approved.\n<\/p>\n
     4.             The learned counsel for the petitioner<\/p>\n
     Shri    V.D.     Hon,   strenuously        contended          that       the<\/p>\n
     Commissioner       vide        impugned      communication               has<\/p>\n
     withdrawn the functions of the petitioner Taluka<\/p>\n
     Sangh, and thereby there is withdrawal of powers<\/p>\n
     and function of the Taluka Sangh given bestowed<\/p>\n
     by Section 69-A of the Societies Act under the<\/p>\n
     legislative functions. According to the learned<\/p>\n
     counsel as per Section Section 69-A (2A), the<\/p>\n
     immediate       initial    supervisory           control         on      the<\/p>\n
     person    appointed       to    the   cadre       and      deputed        or<\/p>\n
     posted to work as Secretary under each of the<\/p>\n
     societies referred in Sub Section (1) shall be<\/p>\n

     with the Taluka          supervising societies consisting<\/p>\n
     of the societies in each respective Taluka to<\/p>\n
     which persons are deputed as members thereof. The<\/p>\n
     Taluka    supervision       society    shall       exercise         such<\/p>\n
     powers and discharge such functions                     or perform<\/p>\n
     such duties as may be conferred or imposed by it,<\/p>\n
     by the bye laws of such society. According to the<\/p>\n
     learned counsel, the said Sub Section (2A) of<\/p>\n
     Section     69
\n                 ig     was     introduced        by      way       of      an<\/p>\n
     amendment,whereby powers were given to the Taluka<\/p>\n
     Supervision        Sangh     society       like        petitioner.\n<\/p>\n
     According    to    the     petitioner’s      learned         counsel,<\/p>\n
     impugned communication is in gross violation of<\/p>\n
     Sub Section (1) and (2A) of Section 69-A of the<\/p>\n
     Maharashtra Co-operative Societies Act, 1960, and<\/p>\n
     as   such        prayed      for      quashing           the        said<\/p>\n
     communication.\n<\/p>\n
     5.          Shri    S.K.     Kadam,     learned         A.G.P.        for<\/p>\n
     respondents submitted that the said communication<\/p>\n
     is perfectly legal and valid and is in consonance<\/p>\n
     with the     Vaidyanathan Committee Report, so also<\/p>\n
     is perfectly in accordance with the Sub Section 7<\/p>\n
     of Section 69-A of the Maharashtra Co-operative<\/p>\n

     Societies        Act,    1960.    Section       69-A       (7)      reads<\/p>\n
     thus :-\n<\/p>\n
           ”      Notwithstanding           anything       contained          in
\n           Sub Section (1) to (6), on and from the 1st
\n           day    of     January,          2009,     nothing        in        sub
\n           sections (1) to (6) shall apply in a co-\n<\/p><\/blockquote>\n
           operative credit structure entity.”<\/p><\/blockquote>\n
\n\n\n           Co-operative            Credit    structure          entity         is\n\n\n\n\n                                   \n     defined     Under\n                  ig         Section    2(10-aii-1)          which       reads\n\n     thus :-\n\n           \" Section 2(10-aii-1)                  \"Cooperative credit\n                \n           structure          entity\"        means        the        primary\n<\/pre>\n
           agricultural credit co-oprative society, the
\n           District Central Co-operative Bank or the<\/p>\n
           State Co-operative Bank.”<\/p><\/blockquote>\n
           Sub Section 7 of section 69-A starts with<\/p>\n
     the   non-obstante        clause,       which    lays       down      that<\/p>\n
     notwithstanding           anything        contained           in         Sub<\/p>\n
     Sections (1) to (6) nothing in Sub Section (1) to<\/p>\n
     (6), would apply to Cooperative, credit structure<\/p>\n
     entity,     as    such    in    view    of    Sub    Section         7    of<\/p>\n
     Section     69-A        the    said    impugned       communication<\/p>\n
     dated 7\/12\/2009 is not contrary to Section 69-A<\/p>\n
     but is in consonance with the same. While reading<\/p>\n
     Section     69-A(1)       and     Sub    section         (2-A),          Sub<\/p>\n

     Section 7 of Section 69-A cannot be ignored.                            It<\/p>\n
     starts with a non-obstante clause, as such effect<\/p>\n
     will have to be given to Sub Section 7 of Section<\/p>\n
     69-A. The said provision categorically lays down<\/p>\n
     that the right envisaged in Sub Section (1) to<\/p>\n
     (6) of Section 69-A would not be available to Co-\n<\/p>\n
     operative     credit    structure           entity.          In      such<\/p>\n
     circumstances, as the impugned communication does<\/p>\n
     not suffer from any illegality, nor is against<\/p>\n
     any provision of law but is in accordance with<\/p>\n
     the   letters    and   spirit      of      Sub     Section         7    of<\/p>\n
     Section     69-A,      the     present           Writ         Petition<\/p>\n
     challenging      the    said       communication              is       not<\/p>\n
     sustainable, as such the Writ Petition deserves<\/p>\n
     to be dismissed.\n<\/p>\n
     6.          In   the     result,         Writ        Petition           is<\/p>\n
     dismissed, there shall be no order as to costs.\n<\/p>\n
