M. SAHAI)<\/p>\n<p>1.\tList<br \/>\nof this Final Hearing Board of Special Civil Applications has been<br \/>\nrevised. No one appears for the petitioner. Ms.Rita Chandarana,<br \/>\nlearned counsel for the respondents is present.\n<\/p>\n<p>2.\tWe<br \/>\nhave heard Ms.Rita Chandarana, learned counsel appearing for the<br \/>\nrespondents.\n<\/p>\n<p>3.\tThis<br \/>\npetition has been filed challenging the order of Central<br \/>\nAdministrative Tribunal, Ahmedabad Bench, Ahmedabad, dated 19.12.2008<br \/>\nby which O.A. No.148 of 2007 filed by the petitioner has been<br \/>\ndismissed.\n<\/p>\n<p>4.\tThe<br \/>\ncase of the petitioner is that he was initially appointed in Baroda<br \/>\nDivision of the respondents and was transferred  from Baroda Division<br \/>\nto Ahmedabad Division on his request. As per para 311 and 312 of the<br \/>\nIndian Railway Establishment Manual, in case of transfer on request,<br \/>\nthe employee will be placed at the bottom of the seniority list at<br \/>\nthe transferred place. Since the petitioner had requested  for<br \/>\ntransfer, he was placed junior in the seniority list in Ahmedabad<br \/>\nDivision in the year 1982.  The seniority list for promotion was<br \/>\nprepared on 20.7.2004 and was published on 17.8.2004, and the select<br \/>\nlist was published on 5.7.2004. But the petitioner did not submit any<br \/>\nrepresentation against the seniority list. Since the petitioner was<br \/>\nplaced at the bottom of the seniority list of Ahmedabad Division, he<br \/>\nwas junior to other employees who were promoted. Moreover, the order<br \/>\ndated 7.4.1982  by which the petitioner was transferred and placed at<br \/>\nthe bottom of the seniority list, was never challenged by the<br \/>\npetitioner nor the persons who would be affected by the challenge to<br \/>\nthe seniority list were made party before the Tribunal, nor any<br \/>\nspecific grievance has been raised against them.\n<\/p>\n<p>5.\tFor<br \/>\nthe aforesaid reasons, we do not find any illegality in the impugned<br \/>\norder of the Tribunal dated 19.12.2008 passed in O.A.No. 148 of 2007.\n<\/p>\n<p>6.\tThis<br \/>\npetition is devoid of any merits and is accordingly dismissed. Rule<br \/>\nis discharged.
