The petitioner complains about encroachment on<br \/>\n                     a public road in Mahadeva Mohalla in Siwan town.\n<\/p>\n<p>                                Earlier the petitioner had approached this Court<br \/>\n                     in CWJC No. 3973 of 2010 in the same subject matter. By<br \/>\n                     the order dated 08.03.2010 the petitioner was directed to<br \/>\n                     approach the concerned authority under the Bihar Public<br \/>\n                     Land Encroachment Act, 1956 (hereinafter referred to as<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>        `the Act&#8217;). The petitioner did approach the Siwan<br \/>\n        municipality in the subject matter. The Siwan municipality<br \/>\n        has, under the order dated 04.08.2010, rejected the request<br \/>\n        on the ground that the encroachment complained of is on a<br \/>\n        private land and not on a public land. Feeling aggrieved the<br \/>\n        petitioner has preferred this petition in public interest.\n<\/p>\n<p>                  As it has been held that the encroachment in<br \/>\n        question is not on a public land, the authority under the Act<br \/>\n        cannot be invoked. If aggrieved, the petitioner has statutory<br \/>\n        remedy of appeal under Section 11 of the Act. The petition<br \/>\n        in the present nature is not maintainable.\n<\/p>\n<p>                  The petition is dismissed in limine.<\/p>\n<pre>\n\n                                   ( R.M.
