AIYUB\n                                          Versus\n                               THE STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p>3   20.04.2011                Heard learned counsels for the petitioner and<\/p>\n<p>                 the State.\n<\/p>\n<p>                              The   petitioner   being   the   husband   is<\/p>\n<p>                 apprehending his arrest in a case registered under<\/p>\n<p>                 Section 304B\/34 of the Indian Penal Code.<\/p>\n<p>                              The petitioner is not named in the F.I.R. The<\/p>\n<p>                 marriage was performed four years prior to the<\/p>\n<p>                 occurrence. There is allegation of demand of dowry<\/p>\n<p>                 and the victim died when she was pregnant.<\/p>\n<p>                              It is submitted by learned counsel for the<\/p>\n<p>                 petitioner that the victim was suffering from abdominal<\/p>\n<p>                 pain for which she was being treated. The postmortem<\/p>\n<p>                 report of the victim reflects no external injury.<\/p>\n<p>                              Considering the fact that the petitioner was<\/p>\n<p>                 not named in the F.I.R and during the investigation, no<\/p>\n<p>                 external injury was found, let the above named<\/p>\n<p>                 petitioner, be released on anticipatory bail, in the event<\/p>\n<p>                 of his arrest or surrender before the learned Court<br \/>\n<span class=\"hidden_text\">                              -2-<\/span><\/p>\n<p>             below within a period of 12 weeks from today, on<\/p>\n<p>             furnishing bail bond of Rs. 10,000\/- (ten thousand)<\/p>\n<p>             with two sureties of the like amount each to the<\/p>\n<p>             satisfaction of the learned Chief Judicial Magistrate,<\/p>\n<p>             Araria in connection with Jokihat (Mahalgaon) P.S.<\/p>\n<p>             Case No. 185\/2010, subject to the conditions as laid<\/p>\n<p>             down under Section 438(2) Cr.P.C.\n<\/p>\n<\/p>\n<p>                                        (Dinesh Kumar Singh, J.)<br \/>\nAmrendra\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.
