SANKARAN, J.\n                       ---------------------------\n                 B.A. Nos. 1009 &amp; 1010 of 2010\n                ------------------------------------------\n                Dated this the 4th day of March, 2010\n\n\n                              O R D E R\n<\/pre>\n<p>      Petitioner had filed Bail application Nos. 7105 and 7106 of<\/p>\n<p>2009    for   anticipatory    bail  in   Crime     No.   242\/2009 of<\/p>\n<p>Sreekandapuram Police Station, Kannur District and Crime No.<\/p>\n<p>77\/2009 of Payyavoor Police Station, Kannur District. Those bail<\/p>\n<p>applications were dismissed by the common order dated<\/p>\n<p>11.12.2009. For the same relief, which was prayed for in B.A.<\/p>\n<p>Nos.7105 and 7106\/2009, the petitioner has filed these Bail<\/p>\n<p>Applications.\n<\/p>\n<p>      2. For the sake of convenience, the order dated 11.12.2009<\/p>\n<p>is extracted below:\n<\/p>\n<blockquote><p>                 &#8220;These Bail Applications are filed by<\/p>\n<p>            M.P. Muhammed Kunhi, who is the second<\/p>\n<p>            accused in Crime No.77\/2009 of Payyavoor<\/p>\n<p>            Police Station and the sole accused in Crime<\/p>\n<p>            No.242\/2009 of Sreekandapuram Police<\/p>\n<p>            Station. The offence        alleged in Crime<\/p>\n<p>            No.77\/2009 is under Section 5 of the<\/p>\n<p>            Explosive Substances Act, while the offence<\/p>\n<p><span class=\"hidden_text\">B.A. Nos. 1009 &amp; 1010\/2010          2<\/span><\/p>\n<p>                 alleged in Crime No. 242\/2009 is under<\/p>\n<p>                 Section 4 of the Explosive Substances Act.<\/p>\n<\/blockquote>\n<blockquote><p>                        2.  The prosecution case is that on<\/p>\n<p>                 14\/7\/2009, a search was conducted in a<\/p>\n<p>                 quarry owned by the first accused, P.D.<\/p>\n<p>                 John @ Thankachan. On such search, the<\/p>\n<p>                 police could find two fuse wires and 45<\/p>\n<p>                 detonators. It was revealed that those<\/p>\n<p>                 explosive substances were given to the first<\/p>\n<p>                 accused by M.P. Muhammed Kunhi, the<\/p>\n<p>                 petitioner herein. It would appear that<\/p>\n<p>                 Payyavoor      police gave information to<\/p>\n<p>                 Seekandapuram       Police,   within  whose<\/p>\n<p>                 jurisdiction  the   petitioner  resides and<\/p>\n<p>                 carries on business. On 4\/11\/2009, Crime<\/p>\n<p>                 No.242\/2009 was registered before the<\/p>\n<p>                 Sreekandapuram Police Station. A search<\/p>\n<p>                 was conducted in a shop building in the<\/p>\n<p>                 possession of the petitioner. The petitioner<\/p>\n<p>                 was running a business under the name and<\/p>\n<p>                 style &#8220;National Fire Works&#8221; in the building.<\/p>\n<p>                 At the time when the police party reached<\/p>\n<p>                 there, the building was found locked. On<\/p>\n<p>                 enquiry to the neighbouring shop owner, he<\/p>\n<p>                 stated that key of the shop room        was<\/p>\n<p><span class=\"hidden_text\">B.A. Nos. 1009 &amp; 1010\/2010          3<\/span><\/p>\n<p>                 handed over to him by the petitioner. The<\/p>\n<p>                 police opened that shop room and found<\/p>\n<p>                 key of another room in the same building.<\/p>\n<p>                 That room was also opened. In that room,<\/p>\n<p>                 large quantity of explosive substances were<\/p>\n<p>                 found. The police found 1148 detonators,<\/p>\n<p>                 4.5 Kgs of fuse wire and more than 110 Kgs<\/p>\n<p>                 of Ammonium Nitrate.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>                        3.  The Investigating Officer could<\/p>\n<p>                 not arrest the petitioner          as he was<\/p>\n<p>                 absconding. The petitioner has filed this<\/p>\n<p>                 application for anticipatory bail without<\/p>\n<p>                 disclosing the real facts. It is stated that the<\/p>\n<p>                 building,   where     from     the    explosive<\/p>\n<p>                 substances were recovered , does not<\/p>\n<p>                 belong to him. There are records to indicate<\/p>\n<p>                 that the room was taken on rent by the<\/p>\n<p>                 petitioner. Neighbouring shop owner has<\/p>\n<p>                 also given information that the room in<\/p>\n<p>                 question was in the possession of the<\/p>\n<p>                 petitioner.   Necessary        materials were<\/p>\n<p>                 collected by the investigating officer to<\/p>\n<p>                 show that the building in question is in the<\/p>\n<p>                 possession of the petitioner. The offence<\/p>\n<p>                 alleged against the petitioner is very<\/p>\n<p><span class=\"hidden_text\">B.A. Nos. 1009 &amp; 1010\/2010          4<\/span><\/p>\n<p>                 serious in nature. Grant of anticipatory bail<\/p>\n<p>                 cannot be made in such cases, where large<\/p>\n<p>                 quantity of explosive substances were<\/p>\n<p>                 found in the possession of the accused.<\/p>\n<p>                 Discretionary relief under Section 438<\/p>\n<p>                 cannot be      granted in favour of the<\/p>\n<p>                 petitioner in the facts and circumstances of<\/p>\n<p>                 the case. Therefore, I am of the view that<\/p>\n<p>                 the petitioner is not entitled to an order<\/p>\n<p>                 under Section 438 of the Code of Criminal<\/p>\n<p>                 Procedure. If anticipatory bail is granted to<\/p>\n<p>                 the petitioner, it would adversely affect the<\/p>\n<p>                 proper investigation of the case.<\/p>\n<\/blockquote>\n<blockquote><p>                        For the aforesaid reasons, the Bail<\/p>\n<p>                 Applications are dismissed.&#8221;<\/p><\/blockquote>\n<p>        3. The learned counsel for the petitioner submitted that in<\/p>\n<p>Crime No.77\/2009, anticipatory bail was granted to accused No.1<\/p>\n<p>and that fact was omitted to be brought to the notice of this<\/p>\n<p>Court       while      disposing of Bail    Application  Nos.7105 and<\/p>\n<p>7106\/2009. Even if it were brought to the notice of the Court, the<\/p>\n<p>same order would have been passed, since the role played by the<\/p>\n<p>first accused and second accused are quite different and distinct.<\/p>\n<p><span class=\"hidden_text\">B.A. Nos. 1009 &amp; 1010\/2010     5<\/span><\/p>\n<p>I do not think that there is any justifiable reasons or grounds for<\/p>\n<p>entertaining a second round of applications for the same relief.<\/p>\n<p>        Accordingly, the Bail Applications are dismissed.<\/p>\n<p>                                    K.T.
