Kuriakose, J<\/p>\n<p>     On considering the submissions of Sri.K.Anand,<\/p>\n<p>the learned counsel for the petitioners in extenso, we<\/p>\n<p>found that there is no warrant for interfering with the<\/p>\n<p>orders of eviction concurrently passed by the Rent<\/p>\n<p>Control Court and the Appellate Authority and in<\/p>\n<p>deference to the learned counsel for the petitioner&#8217;s<\/p>\n<p>request that time be granted to vacate at least till<\/p>\n<p>31\/12\/09, we issued notice to the respondents vide<\/p>\n<p>our order dt.04\/03\/09 which reads as follows:-<\/p>\n<blockquote><p>           &#8220;Heard Sri.K.Anand, learned counsel<br \/>\n     for the petitioners in extenso. We are not<br \/>\n     satisfied that any ground is made out<br \/>\n     under the attenuated jurisdiction of this<br \/>\n     Court under Section 20 for interfering with<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.50 of 2009            -2-<\/span><\/p>\n<p>            the orders of eviction concurrently passed<br \/>\n            by the Rent Control Court and the<br \/>\n            Appellate Authority. However, in deference<br \/>\n            to the learned counsel&#8217;s request that time<br \/>\n            be   granted   to   vacate     at  least  till<br \/>\n            31\/12\/2009, we are inclined to issue<br \/>\n            notice to the respondent to decide the<br \/>\n            question of granting time.<\/p>\n<blockquote><p>                 Issue notice on admission by speed<br \/>\n            post to decide the question of time to be<br \/>\n            granted to the petitioner for surrendering<br \/>\n            the premises. Post on 16\/03\/09. Interim<br \/>\n            stay, as prayed for, till then.&#8221;\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>            2. In response to the notice issued, the<\/p>\n<p>      respondents entered appearance through Advocate<\/p>\n<p>      Sri.P.C.Chacko. Sri.T.Krishnanunni, Senior Counsel<\/p>\n<p>      who was engaged to argue the revision petition on<\/p>\n<p>      behalf of the petitioners after getting permission<\/p>\n<p>      addressed us on the merits of the various grounds<\/p>\n<p>      raised in the memorandum of revision and submitted<\/p>\n<p>      that the revision be allowed notwithstanding our order<\/p>\n<p>      dt.04\/03\/09.    Drawing    our     attention  to   certain<\/p>\n<p>      observations of the Rent Control Appellate Authority in<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.50 of 2009          -3-<\/span><\/p>\n<p>      para 10 of its judgment, Sri.Krishnanunni submitted<\/p>\n<p>      that the respondent is presently gainfully employed as<\/p>\n<p>      a Development Officer with the LIC of India and<\/p>\n<p>      therefore, the need projected by him under sub<\/p>\n<p>      Section 3 of Section 11 is no longer in existence.<\/p>\n<p>      According to the Senior Counsel, since the need has<\/p>\n<p>      been completely obliterated, the order of eviction<\/p>\n<p>      under Section 11(3) passed, concurrently though it be,<\/p>\n<p>      is to be vacated since the law is that the need should<\/p>\n<p>      continue at least till the final authority under the<\/p>\n<p>      statutory scheme i.e. this Court the revisional<\/p>\n<p>      authority under Section 20 passes orders. When the<\/p>\n<p>      attention of Sri.P.C.Chacko was drawn to this aspect of<\/p>\n<p>      the matter, Sri.P.C.Chacko, learned counsel for the<\/p>\n<p>      respondent fairly conceded before us that the<\/p>\n<p>      respondent is presently working as a Development<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.50 of 2009           -4-<\/span><\/p>\n<p>      Officer with the LIC of India. He submitted that a<\/p>\n<p>      detailed affidavit has been filed by the respondent on<\/p>\n<p>      26\/05\/09. Paragraphs 3 and 4 of the said affidavit are<\/p>\n<p>      relevant and hence, we quote those paragraphs<\/p>\n<p>      asunder:-\n<\/p><\/blockquote>\n<blockquote><p>                  &#8220;I respectfully submit that the main<br \/>\n           contention of the revision petitioner is that<br \/>\n           &#8216;now I have got an employment and the<br \/>\n           need    is   not  subsisting&#8217;.   The   above<br \/>\n           contention is not correct and denied. I<br \/>\n           respectfully   submit    that  the   revision<br \/>\n           petitioner is taking different contentions<br \/>\n           with regard to my employment throughout<br \/>\n           the various stages of these proceedings.<br \/>\n           When the counter was filed in the RCP on<br \/>\n           16\/05\/2005, the main contention of the<br \/>\n           respondent was that &#8216;at that time I was<br \/>\n           engaged in gulf countries and when DW1<br \/>\n           was examined he was deposed that I was<br \/>\n           working in the press, which is conducted by<br \/>\n           my father. On 08\/08\/2007, when the RCA<br \/>\n           was filed, the main ground taken by the<br \/>\n           respondent was that I had got government<br \/>\n           job and when the RCA was taken up for<br \/>\n           hearing, the main grounds urged by the<br \/>\n           tenant as reflected in the judgment of the<br \/>\n           court below is that I have got employment<br \/>\n           in LIC and finally on 26\/02\/09 when the<br \/>\n           RCR is filed, the main contention taken by<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.50 of 2009           -5-<\/span><\/p>\n<p>            the tenant is that I am employed in the<br \/>\n            Indus Ind Bank, Thiruvalla. So these<br \/>\n            contentions are not genuine and true. They<br \/>\n            are inconsistent.\n<\/p><\/blockquote>\n<blockquote><p>                 I respectfully submit that I am an<br \/>\n            MBA graduate and I am temporarily<br \/>\n            employed and I want to resign from the job<br \/>\n            as soon as the petition schedule building<br \/>\n            involved in the RCR is obtained vacant<br \/>\n            possession of. The need is still subsisting. I<br \/>\n            bona fide intend to start business as alleged<br \/>\n            in the RCP. That apart, my wife and two of<br \/>\n            my younger brothers though reasonably<br \/>\n            educated are unemployed and are ready<br \/>\n            and willing to assist me in the conduct of<br \/>\n            business.&#8221;<\/p><\/blockquote>\n<\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>            3. According to Sri.P.C.Chacko, the moment the<\/p>\n<p>      respondent obtains possession of the petition schedule<\/p>\n<p>      building, he will submit his resignation to the LIC so<\/p>\n<p>      that he can occupy the building and carry on the<\/p>\n<p>      projected business therein.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>            4. Sri.Krishnanunni, the learned counsel for the<\/p>\n<p>      petitioners would assail the findings of the authorities<\/p>\n<p>      below in the context of the second proviso to Sub<\/p>\n<p>      Section 3 of Section 11. He submitted that as far as<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.50 of 2009           -6-<\/span><\/p>\n<p>      the first limb of second proviso is concerned, the<\/p>\n<p>      findings have been entered concurrently in favour of<\/p>\n<p>      the tenant and in the absence of any challenge by the<\/p>\n<p>      landlord, the finding in the context of that limb is to be<\/p>\n<p>      accepted by this Court. According to him, the finding<\/p>\n<p>      on the second limb of second proviso though<\/p>\n<p>      concurrently entered by the authorities in favour of the<\/p>\n<p>      landlords, is contrary to the evidence actually available<\/p>\n<p>      on record. He submitted that the landlord had taken<\/p>\n<p>      out a commission to report that certain buildings<\/p>\n<p>      mentioned by him are lying vacant in the locality. The<\/p>\n<p>      Commissioner filed report and he was examined also<\/p>\n<p>      on the side of the landlord. The report of the Advocate<\/p>\n<p>      Commissioner is actually in favour of the tenant.<\/p>\n<p>      Instead of relying on that evidence which was brought<\/p>\n<p>      on record by the landlord, what the authorities below<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.50 of 2009           -7-<\/span><\/p>\n<p>      have done is to decide on the basis of what is<\/p>\n<p>      described as certain admissions in the evidence of the<\/p>\n<p>      tenant that other buildings are available in the locality.<\/p>\n<p>      The learned senior counsel was permitted to read over<\/p>\n<p>      to us the evidence rendered by the tenant in the<\/p>\n<p>      context of the second limb of the second proviso. He<\/p>\n<p>      submitted that the said evidence will not go to show<\/p>\n<p>      that other suitable buildings are presently available in<\/p>\n<p>      the locality.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>           5. The submissions of the learned senior counsel<\/p>\n<p>      were resisted by Sri.P.C.Chacko. Sri.Chacko submitted<\/p>\n<p>      that the landlord is an MBA degree holder and he<\/p>\n<p>      cannot be expected to be idle during the pendency of<\/p>\n<p>      the eviction proceedings. He is engaging himself<\/p>\n<p>      presently as a Development Officer with the LIC of<\/p>\n<p>      India. According to Sri.Chacko, once the delivery of<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.50 of 2009            -8-<\/span><\/p>\n<p>      the petition schedule building is obtained, the revision<\/p>\n<p>      petitioner will quit the job and occupy the building for<\/p>\n<p>      carrying on business. The learned counsel relied on<\/p>\n<p>      the judgments of the Supreme Court in <a href=\"\/doc\/1512249\/\">Pratap Rai<\/p>\n<p>      Tanwani v. Uttam Chand<\/a> (2004(8) SCC 490), <a href=\"\/doc\/690250\/\">Sait<\/p>\n<p>      Nagjee Purushotham &amp; Co. Ltd. v. Vimalabai Prabhulal<\/a><\/p>\n<p>      (2005(8)    SCC      252),   <a href=\"\/doc\/217631\/\">Ramkubai    v.   Hajarimal<\/p>\n<p>      Dhokalchand      Chandak<\/a>       (1999(6)   SCC     540),<\/p>\n<p>      <a href=\"\/doc\/231653\/\">Kamleshwar Prasad v. Pradumanju Agarwal<\/a> (1997(4)<\/p>\n<p>      SCC 413) to substantiate his contentions. With regard<\/p>\n<p>      to sub Section 12 of Section 11, counsel submitted<\/p>\n<p>      that the statute gives adequate protection to a tenant<\/p>\n<p>      who has been evicted on ground of own occupation<\/p>\n<p>      unnecessarily.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>            6. Coming to Sri.T.Krishnanunni&#8217;s arguments in<\/p>\n<p>      the context of second proviso to sub Section 3 of<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.50 of 2009           -9-<\/span><\/p>\n<p>      Section 11, Sri.P.C.Chacko would remind us of the<\/p>\n<p>      contours of this Court&#8217;s jurisdiction under Section 20.<\/p>\n<p>      According to him, the appellate authority has made a<\/p>\n<p>      thorough re-appraisal of the evidence and concluded<\/p>\n<p>      on the basis of such re-appreciation that the tenant<\/p>\n<p>      has not discharged his burden to show that he satisfies<\/p>\n<p>      the second limb of the second proviso to sub Section<\/p>\n<\/blockquote>\n<blockquote><p>      3. The finding in favour of the tenant in the context of<\/p>\n<p>      the first limb will not be of much consequence since<\/p>\n<p>      both the limbs are in the conjunctive.<\/p>\n<\/blockquote>\n<blockquote><p>           7. We have anxiously considered the rival<\/p>\n<p>      submissions addressed at the Bar. We do find force<\/p>\n<p>      with the submission of the learned Senior counsel that<\/p>\n<p>      so long as the respondent is employed with the LIC,<\/p>\n<p>      he will not be able to accomplish his projected need of<\/p>\n<p>      carrying on business in the petition schedule building.<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.50 of 2009           -10-<\/span><\/p>\n<p>      But then, the landlord has filed an affidavit before this<\/p>\n<p>      Court which prima facie appears to be convincing.<\/p>\n<p>      According to us, the apprehension voiced by the<\/p>\n<p>      learned senior counsel for the petitioner can be taken<\/p>\n<p>      care of by insisting that the respondent resigns his job<\/p>\n<p>      with the LIC before revision petitioner is dispossessed<\/p>\n<p>      of  the    petition   schedule   building.  Appropriate<\/p>\n<p>      directions in this regard are being incorporated in this<\/p>\n<p>      judgment.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>           8. It is trite that both the limbs of the second<\/p>\n<p>      proviso to Sub Section 3 are to be taken in the<\/p>\n<p>      conjunctive and that the burden is that of the tenant<\/p>\n<p>      to establish that he satisfies both the limbs. In order<\/p>\n<p>      that he is given the protection of the second proviso to<\/p>\n<p>      sub Section 3 at the instance of the landlord, a<\/p>\n<p>      Commissioner was appointed and the Commissioner<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.50 of 2009           -11-<\/span><\/p>\n<p>      filed a report and gave evidence which was not very<\/p>\n<p>      favourable to the landlord regarding the second limb<\/p>\n<p>      of second proviso to Sub Section 3. But then the<\/p>\n<p>      burden as settled by judicial precedent continues with<\/p>\n<p>      the tenant.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>            9. The tenant examined a few witnesses who<\/p>\n<p>      according to the landlord were owners of other<\/p>\n<p>      buildings which are remaining vacant in the locality.<\/p>\n<p>      The learned Appellate Authority has made a thorough<\/p>\n<p>      re-appraisal of the evidence given by these witnesses.<\/p>\n<p>      It was found by the appellate authority that the tenant<\/p>\n<p>      has made a fatal admission while giving evidence as<\/p>\n<p>      PW1 that Mullackal is an area where buildings are<\/p>\n<p>      falling vacant and are let and re-let. May be the above<\/p>\n<p>      admission is a too general one to form basis of a<\/p>\n<p>      finding that the tenant is not entitled to a protection of<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.50 of 2009          -12-<\/span><\/p>\n<p>      the second limb of the second proviso to sub section<\/p>\n<\/blockquote>\n<blockquote><p>      3. But as we have indicated the burden was that on<\/p>\n<p>      the tenant and we find from the testimony of RW1<\/p>\n<p>      itself that the tenant has not made any serious<\/p>\n<p>      enquiry on the question of availability of the vacant<\/p>\n<p>      buildings. Locality for the purpose of the second<\/p>\n<p>      proviso to sub Section 3 is not the immediate vicinity<\/p>\n<p>      of the petition schedule building alone. It is a fairly<\/p>\n<p>      larger area and the tenant was expected to have<\/p>\n<p>      enquiries in other areas of Alappuzha. Under the<\/p>\n<p>      statutory scheme, the final court on facts is the<\/p>\n<p>      appellate authority. That authority concurring with the<\/p>\n<p>      Rent Control Court has found that the tenant has<\/p>\n<p>      failed in establishing that he satisfies the second<\/p>\n<p>      proviso to sub Section 3. It is not possible for us to<\/p>\n<p>      say that those findings are so wholly unreasonable as<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.50 of 2009           -13-<\/span><\/p>\n<p>      to warrant correction under the revisional jurisdiction<\/p>\n<p>      of Section 20.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>           10. The result is that impugned orders will stand<\/p>\n<p>      confirmed and the RCR will stand dismissed.<\/p>\n<\/blockquote>\n<blockquote><p>           11. As his last request, the learned Senior<\/p>\n<p>      counsel for the petitioner sought for one year&#8217;s time to<\/p>\n<p>      surrender the premises peacefully. Sri.P.C.Chacko, the<\/p>\n<p>      learned counsel for the respondent stiffly opposed this<\/p>\n<p>      request. We are not inclined to grant so much of time.<\/p>\n<p>      However, we feel that in the circumstances of the case<\/p>\n<p>      and by way of indulgence time can be granted till, 21st<\/p>\n<p>      December, 2009 subject to the following conditions:-<\/p>\n<\/blockquote>\n<blockquote><p>           12. Revision petitioner shall file an affidavit<\/p>\n<p>      within three weeks from today stating that he will<\/p>\n<p>      peacefully surrender the petition schedule building to<\/p>\n<p>      the respondent on or before 31\/12\/09 and that he will<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.50 of 2009          -14-<\/span><\/p>\n<p>      discharge arrears of rent, if any, and will continue to<\/p>\n<p>      pay occupational charges at the present rent of<\/p>\n<p>      Rs.115\/- per mensm till he surrenders. It is made<\/p>\n<p>      clear that the revision petitioner will get the benefit of<\/p>\n<p>      time granted by this order only if he files an affidavit<\/p>\n<p>      within the time frame.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                          PIUS C.
