Justice HARUN-UL-RASHID\n\n Dated :24\/09\/2010\n\n O R D E R\n                       HARUN-UL-RASHID, J.\n                        ------------------------\n                     W.P.(C).No.10826 Of 2009\n                         ----------------------\n             Dated this the 24th day of September, 2010.\n\n                           J U D G M E N T\n<\/pre>\n<p>     Petitioner is the plaintiff in O.S.No.54 of 2007 on the file of<\/p>\n<p>the Additional Munsiff Court, Kottayam. Ext.P2 is the judgment<\/p>\n<p>in O.S.No.54 of 2007.          The Munsiff Court passed a decree<\/p>\n<p>allowing the plaintiff to realise the amount stated with interest.<\/p>\n<p>Plaintiff filed Ext.P3 application under Section 152 Code of Civil<\/p>\n<p>Procedure     for   correcting    the  decree     and  judgment  by<\/p>\n<p>incorporating the following details:<\/p>\n<blockquote><p>               &#8220;1.  The suit is for realisation of money and for<\/p>\n<p>        mandatory injunction stopping the use of the plaint<\/p>\n<p>        schedule building by the defendant.\n<\/p><\/blockquote>\n<blockquote><p>               2.   The relief C in the plaint to be allowed by<\/p>\n<p>        incorporating the direction to the defendant to stop<\/p>\n<p>        the use of the building by an order of mandatory<\/p>\n<p>        injunction within a time to be fixed by the Court and<\/p>\n<p>        in case of failure of the defendant obey that direction<\/p>\n<p>        to allow the plaintiff to execute the order.<\/p>\n<\/blockquote>\n<blockquote><p>               3.   To allow the plaintiff to realise 18%<\/p>\n<p>        interest on the arrears from the date of suit till the<\/p>\n<p>        date of decree and allowing the cost of the suit.&#8221;<\/p>\n<\/blockquote>\n<p>W.P.(C).No.10826 Of 2009<\/p>\n<p>                                 ::2::\n<\/p>\n<p>      2.   The court is empowered to correct the decree and<\/p>\n<p>judgment in case there is any clerical or arithmetical mistake.<\/p>\n<p>The Additional Munsiff, Kottayam by Ext.P4 order dismissed the<\/p>\n<p>petition stating that the prayer sought did not come within the<\/p>\n<p>purview of Section 152 Code of Civil Procedure.        Ext.P4 order<\/p>\n<p>passed by the court below is under challenge in this writ petition<\/p>\n<p>filed under Article 227 of the Constitution of India. in the facts<\/p>\n<p>and circumstances of the case this Court fully agree with the<\/p>\n<p>reasons stated by the learned Munsiff.<\/p>\n<p>      3.
