LTD. - Petitioner(s)\n \n\nVersus\n \n\nGUJARAT\nELECTRICITY BOARD - Respondent(s)\n \n\n=========================================================\n \nAppearance : \nMR\nRAVI KARNAVAT for Petitioner(s) : 1, \nMR DIPAK R DAVE for\nRespondent(s) :\n1, \n========================================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n\t\n        Date : 20\/01\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition, the petitioner has prayed to quash and set<br \/>\naside the impugned order dated 22.07.2003 passed by the<br \/>\nrespondent-Board in Appeal No. B-158\/2003, whereby the appellate<br \/>\nauthority has partly allowed the appeal and directed the respondent<br \/>\nto revise the Special Bill by taking chargeable days as 154 and C\/B<br \/>\nas 0.37 with connected load parameter.\n<\/p>\n<p>2.\t\tThe<br \/>\nshort facts of the case are that the petitioner-Company is having its<br \/>\ncement factory at GIDC Estate, Bhuj. Initially the petitioner-Company<br \/>\ntook a load of 90 HP for running the factory. In the year 2000, the<br \/>\npetitioner made an application to the respondent for increase in the<br \/>\nload. Thereafter, again on 21.05.2002, the petitioner made another<br \/>\napplication for increase of load from 90 HP to 121 HP.  Pursuant<br \/>\nthereto, the respondent sanctioned the additional load and the same<br \/>\nwas made effective from 25.06.2002.\n<\/p>\n<p>2.1.\t\tOn<br \/>\n12.09.2002, the respondent raided the premises of the petitioner,<br \/>\nwhereby it was allegedly found that the petitioner had committed<br \/>\ntheft of energy. Thereafter, the meter was sent for laboratory test.<br \/>\nPursuant thereto, the respondent issued a bill of Rs.8,28,592\/-<br \/>\ntogether with penalty. Being aggrieved by the same, the petitioner<br \/>\npreferred an appeal being Appeal No.B-158\/2003 before the appellate<br \/>\ncommittee, after depositing 30% of bill amount. The appellate<br \/>\ncommittee vide order dated 22.07.2003 partly allowed the appeal and<br \/>\nissued a revised bill of Rs.5,40,760.68 paise.  Hence, this petition.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. It is the case of the petitioner that though the  meter<br \/>\nwas found in a proper working condition and simply because some<br \/>\nscratches were found on the female part of the seal, the appellate<br \/>\ncommittee has opined that the petitioner has tampered with the meter.<br \/>\n On perusal of the documents on record, it transpires that the MMB<br \/>\nseal was also  tampered with  apart from the scratches that were<br \/>\nfound on the female part of the seal. The said tampering clearly<br \/>\nleads us to believe that the petitioner had tampered with the meter<br \/>\nbody seal and had opened the meter and thereafter diverted the<br \/>\nelectricity supply  to other connection. In view of the above<br \/>\nirregularity, the authority found that the petitioner had committed<br \/>\ntheft of energy.\n<\/p>\n<p>4.\t\tLooking<br \/>\nto the facts of the case and the documents on record, I am of the<br \/>\nopinion that the respondent  was completely justified in partly<br \/>\nallowing the appeal of the petitioner. Hence,  I  find no reason to<br \/>\ninterfere with the same in exercise of powers under Article 226 of<br \/>\nthe Constitution of India.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe result, the petition is dismissed.   Rule is discharged.
