Nasrul Hoda, Advocate.\n          Counsel for the Respondents:\n                                   -----------\n<\/pre>\n<p>04.   21.06.2011            This letters patent appeal has been filed<\/p>\n<p>                   against the order dated 26.09.1996 passed by the<\/p>\n<p>                   learned Single Judge in C.W.J.C. No. 4781 of 1995, by<\/p>\n<p>                   which the learned Single Judge dismissed the writ on<\/p>\n<p>                   the ground that in the counter affidavit filed by the<\/p>\n<p>                   State it was stated that appointment letter of the<\/p>\n<p>                   petitioner was forged and it was further stated in the<\/p>\n<p>                   counter affidavit that the claim of the petitioner was<\/p>\n<p>                   examined at length by the government authority and<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>his claim was rejected holding that the appointment<\/p>\n<p>letter of the petitioner was forged.\n<\/p>\n<p>          The petitioner claimed that he was appointed<\/p>\n<p>on 27th November, 1984 and he was paid salary for 25<\/p>\n<p>months and thereafter his salary was stopped without<\/p>\n<p>any termination order. Thereafter the petitioner filed a<\/p>\n<p>writ petition before a Bench and petition was<\/p>\n<p>withdrawn by him with liberty to make representation<\/p>\n<p>before the concerned government authority.          The<\/p>\n<p>representation    was    made   before   the   concerned<\/p>\n<p>authority and the representation of the petitioner was<\/p>\n<p>rejected vide order dated 27.02.1992. Feeling aggrieved<\/p>\n<p>the petitioner filed CWJC No.4781 of 1993, which was<\/p>\n<p>dismissed by the impugned order. It has been stated in<\/p>\n<p>Para-13 of the writ petition that there are two other<\/p>\n<p>persons appointed by the same appointment letter and<\/p>\n<p>they are still working and discharging their duties.<\/p>\n<p>There are two counter affidavits filed by the<\/p>\n<p>respondents.     One is by respondent No.4 in which<\/p>\n<p>paragraph-13 has not been replied.       It contains the<\/p>\n<p>general statement of the facts on behalf the Deputy<\/p>\n<p>Director Education (respondent No.3) and another<br \/>\n<span class=\"hidden_text\">                     3<\/span><\/p>\n<p>counter affidavit has been filed by respondent No.4,<\/p>\n<p>who is the Sub-Divisional Education officer, (South)<\/p>\n<p>Arrah, in his counter affidavit in para-13 the reply of<\/p>\n<p>para-13 of the writ petition has been given that the<\/p>\n<p>statement contained in para-13 of the writ petition<\/p>\n<p>requires no comment. Thus, the statement made in<\/p>\n<p>paragraph-13 of the writ petition stands unrebutted.<\/p>\n<p>Thus, if the appointment letter was forged then the<\/p>\n<p>payment of all the three persons appointed by the same<\/p>\n<p>order should have been stopped not the petitioner only.<\/p>\n<p>This itself shows that the stand of the respondents that<\/p>\n<p>the appointment letter of the petitioner was forged<\/p>\n<p>stands belied.\n<\/p>\n<p>          Not only this, F.I.R., was lodged against the<\/p>\n<p>petitioner and criminal trial was held in which though<\/p>\n<p>the trial-court convicted the petitioner but in appeal the<\/p>\n<p>appellate court held that the prosecution could not<\/p>\n<p>prove that the appointment letter was forged and the<\/p>\n<p>appointment was duly intimated to a Regional Deputy<\/p>\n<p>Director. These two substantial facts have not been<\/p>\n<p>noticed by the learned Single Judge on which CWJC<\/p>\n<p>deserved to be allowed. Thus, the judgment of the<br \/>\n<span class=\"hidden_text\">                           4<\/span><\/p>\n<p>       learned Single Judge is set aside and letters patent<\/p>\n<p>       appeal is allowed. The petitioner will be taken back on<\/p>\n<p>       duty forthwith as there is no termination order but no<\/p>\n<p>       back wages shall be paid. However, period shall be<\/p>\n<p>       counted for the purpose of pension if the post is<\/p>\n<p>       pensionable.<\/p>\n<pre>\n\n\n\n\n                           ( Prakash Chandra Verma, J. )\n\n\n\nMkr.
