NAOLEKAR\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>1.\tChallenge in this appeal is to the judgment rendered by a<br \/>\nDivision Bench of the Madhya Pradesh High Court at Jabalpur<br \/>\ndirecting acquittal of the respondent (hereinafter referred to as<br \/>\nthe &#8216;accused&#8217;) by setting aside the judgment of learned Second<br \/>\nAdditional Sessions Judge, Chhindwara who had convicted the<br \/>\naccused-respondent for offence punishable under Section 302<br \/>\nof the Indian Penal Code, 1860 (in short the &#8216;IPC&#8217;) and Section<br \/>\n27 of the Arms Act, 1959 (in short the &#8216;Arms Act&#8217;). Life<br \/>\nimprisonment and five years rigorous imprisonment<br \/>\nrespectively were awarded. Accused was charged for having<br \/>\ncommitted the murder of his nephew Mangalu (hereinafter<br \/>\nreferred to as the &#8216;deceased&#8217;).\n<\/p>\n<p>2.\tBackground facts in a nutshell are as under:\n<\/p>\n<p>On 19.8.1987 in the afternoon the deceased had gone to<br \/>\nhis field Kodakodi for ploughing. The respondent who<br \/>\nhappened to be uncle of deceased dissuaded the deceased<br \/>\nfrom ploughing the field. But the deceased continued to<br \/>\nplough the field. The respondent fired at the deceased from his<br \/>\nmuzzle loading gun. The deceased after sustaining the injury<br \/>\nfell on the ground. The respondent rushed to his village and<br \/>\nnarrated about the incident to Ramprasad (PW-3), Maresha<br \/>\n(PW-8) and other villagers that he had shot the deceased,<br \/>\nwhereupon the complainant Jangalu (PW-1) and his father<br \/>\nBhagan Singh (PW-5), Doulot (PW-6) and Maresha (PW-8) went<br \/>\nto the field and saw the deceased lying injured. When the<br \/>\ndeceased was being brought to his house he died on the way.<br \/>\nThe complainant Jangalu along with others went to the police<br \/>\nstation and lodged FIR (Ex.P-10) on 21-8-1987 and<br \/>\ninvestigation proceeded. On the memorandum of the<br \/>\nrespondent (Ex.P-4) muzzle loading gun was recovered and<br \/>\nseized vide Ex.P-5. The police also seized blood stained clothes<br \/>\nof the respondent and sent the seized articles to the FSL,<br \/>\nSagar for chemical examination and report.\n<\/p>\n<p> \tAfter receipt of the report of the chemical examiner (Ex.P-\n<\/p>\n<p>11) and completing the investigation, charge-sheet was<br \/>\nsubmitted. The cognizance of the offence was accordingly<br \/>\ntaken and the case was committed to the Court of sessions for<br \/>\ntrial.\n<\/p>\n<p>The prosecution examined in all ten witnesses at the<br \/>\ntrial.\n<\/p>\n<p>\tThe defence was of false implication on account of the<br \/>\nfamily feud to the land dispute.\n<\/p>\n<p>\tThe trial Court disbelieved the claim of recovery of gun.<br \/>\nIt, however, held that the extra-judicial confession before<br \/>\ncomplainant Jangalu (PW-1), Ramprasad (PW-3) and Maresha<br \/>\n(PW-8) was clearly acceptable and accordingly convicted the<br \/>\naccused as afore-stated.\n<\/p>\n<p>3.\tBeing aggrieved, the accused preferred an appeal before<br \/>\nthe High Court. Primary stand before the High Court was that<br \/>\nthe so called extra judicial confession was not believable. The<br \/>\nprosecution version is totally inconsistent. No explanation has<br \/>\nbeen offered for the delay in lodging the First Information<br \/>\nReport. The High Court found that the evidence relating to<br \/>\nextra judicial confession is clearly unacceptable and<br \/>\naccordingly directed acquittal as noted above.\n<\/p>\n<p>4.\tIn support of the appeal, learned counsel for the<br \/>\nappellant-State submitted that the High Court has not<br \/>\nindicated any basis or reason for discarding the extra judicial<br \/>\nconfession.\n<\/p>\n<p>5.\tLearned counsel for the accused-respondent supported<br \/>\nthe judgment of acquittal.\n<\/p>\n<p>6.\tIt is to be noted that the occurrence took place on<br \/>\n19.8.1987 at about 4.00 p.m. The FIR was lodged on<br \/>\n21.8.1987. From the evidence of PW-8 it appears that the<br \/>\naccused purportedly came and told him about having shot his<br \/>\nnephew i.e. the deceased. He advised the accused to go to the<br \/>\nKotwar of Almod. Ram Prasad (PW-3) is the son of Village<br \/>\nKotwar. PW-1 also stated that when the accused was being<br \/>\ntaken by him, PW-3 and PW-8 to the Police Station, the<br \/>\naccused again confessed having killed the deceased.<br \/>\nAccording to the version of PW-3 the distance between the<br \/>\nplace of occurrence and his house is about 10 K.M. and it<br \/>\ntakes about two hours to reach his place. He has stated that<br \/>\nthe accused reached him at about 4.00 p.m. According to the<br \/>\nFIR and the version of PW-1 and PW-8, the occurrence took<br \/>\nplace at 4.00 p.m. and thereafter PW-8 had advised the<br \/>\naccused to go to the Kotwar of Almod. This statement,<br \/>\ntherefore, is contradictory in the sense that if accused had<br \/>\nmade any confession before PW-3 at about 4.00 p.m. after<br \/>\ntravelling the distance from the house of PW-8, the incidence<br \/>\ncould not have taken place at about 4.00 p.m. as claimed by<br \/>\nPW-1 and PW-3. According to PW-3&#8217;s evidence the accused<br \/>\nwas not carrying weapon i.e. the gun with him when he had<br \/>\ngone to the house of PW-3. PW-3 claimed that he brought<br \/>\naccused with him to the village where PW-1, PW-8 and others<br \/>\nwere present.  He then asked the accused to go home and next<br \/>\nday they started for the police station. Admittedly, the FIR was<br \/>\nlodged on 21.8.1987 at about 1.00 p.m. No explanation<br \/>\nwhatsoever has been offered for the delayed presentation of<br \/>\nthe FIR. It was the specific stand of the prosecution that PWs.<br \/>\n1, 3 and 8 had taken the accused with them to the police<br \/>\nstation where the gun was seized from the accused. This<br \/>\nversion gets totally discredited in view of what the police<br \/>\nofficial (PW-10) stated.  According to him, the statement of the<br \/>\naccused was recorded when he was found after search and the<br \/>\naccused was not before him when the FIR was lodged. He<br \/>\nalongwith some other persons reached Varud village, the place<br \/>\nof occurrence on 22.8.1987. The accused was found after<br \/>\ncovering the village on 24.8.1987. Nothing more need be stated<br \/>\nto show that the so called extra-judicial confession is a myth<br \/>\nand the prosecution version lacks credibility and has been<br \/>\nrightly discarded by the High Court.
