No.4823 of 2008\n                      -------------------------------------\n            Dated this the 12th day of December, 2008\n\n                                  ORDER\n<\/pre>\n<p>      Petitioner faces indictment in a prosecution for the offence<\/p>\n<p>punishable, inter alia, under Section 341 r\/w 34 I.P.C.<\/p>\n<p>Investigation is complete. Final report has already been filed.<\/p>\n<p>Cognizance has been taken. The Calendar Case was registered.<\/p>\n<p>The petitioner was not arrested at any stage. The case has now<\/p>\n<p>been transferred to the list of Long Pending Cases. Reckoning<\/p>\n<p>the petitioner as an absconding accused, coercive processes<\/p>\n<p>have been issued against the petitioner by the learned<\/p>\n<p>Magistrate. The petitioner apprehends imminent arrest.<\/p>\n<p>      2.    According to the petitioner, he is absolutely innocent.<\/p>\n<p>His absence earlier was not wilful or deliberate. He is willing to<\/p>\n<p>surrender before the learned Magistrate and apply for bail. But<\/p>\n<p>he apprehends that his application for regular bail may not be<\/p>\n<p>considered by the learned Magistrate on merits, in accordance<\/p>\n<p>with law and expeditiously. It is therefore prayed that directions<\/p>\n<p>under Section 482 Cr.P.C may be issued in favour of the<\/p>\n<p>petitioner.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No.4823 of 2008         2<\/span><\/p>\n<p>      3.   It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate   and    explain   to   the   learned   Magistrate   the<\/p>\n<p>circumstances under which he could not earlier appear before the<\/p>\n<p>learned Magistrate. I have no reason to assume that the learned<\/p>\n<p>Magistrate would not consider such application on merits, in<\/p>\n<p>accordance with law and expeditiously. Every court must do the<\/p>\n<p>same. No special or specific direction appears to be necessary.<\/p>\n<p>Sufficient general directions have already been issued in <a href=\"\/doc\/1851848\/\">Alice<\/p>\n<p>George v. The Deputy Superintendent of Police<\/a> [2003(1)<\/p>\n<p>KLT 339].\n<\/p>\n<p>      4.
