DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 08\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tRule.\n<\/p>\n<p> Learned APP waives service of rule on behalf of respondent-State.\n<\/p>\n<p>2.\tThis<br \/>\npetition under Articles 226 and 227 of the Constitution of India read<br \/>\nwith Section 482 of the Code of Criminal Procedure, 1973, is filed by<br \/>\nthe petitioner\/original complainant challenging the order passed by<br \/>\nlearned Metropolitan Magistrate, Court No.20, Ahmedabad on 9th<br \/>\nAugust, 2010 in inquiry case No.9\/2008 in exercise of revisional<br \/>\njurisdiction under Section 397 of the Code in Revision Application<br \/>\nNo.203 of 2010.\n<\/p>\n<p>3.\tThe<br \/>\nCourts below have examined the case of the complainant on prima faice<br \/>\nmerit as well as on law and has found that the complainant has no<br \/>\nright to file the complaint and only the concerned Court can file the<br \/>\ncomplaint looking to the provisions of Section 195(1)(b) of the Cr.<br \/>\nP.C. with regard to the offences punishable under Sections 193 to<br \/>\n197, 464 to 468, 470 and 471 of the Indian Penal Code.  The learned<br \/>\nSessions Judge while considering the record of the case has noticed<br \/>\nthat even prima facie no material was found to connect the accused<br \/>\nwith the crime and the complaint appear to be vague.  No case papers<br \/>\nwith regard to medical treatment of Mr. Amit Barot (deceased) was<br \/>\nproduced and the certificate issued by the Doctor dated 23.11.2001,<br \/>\nfor which, number of allegations were levelled, nothing was shown to<br \/>\nthe Court to its genuineness or otherwise.\n<\/p>\n<p>4.\tThe<br \/>\nabove findings of facts as well as law, according to learned counsel<br \/>\nfor the petitioner-complainant are contrary to law and submitted that<br \/>\nhaving sent the complaint for inquiry under Section 202 of the Code<br \/>\nrejection of the complaint on the ground that complaint is barred<br \/>\nunder provisions of Sections 195(1) (a) (i) (ii) (iii) of the Cr.<br \/>\nP.C. After receiving the report of the inquiry officer is not just<br \/>\nand proper and deserves to be interfered with.  It is further<br \/>\nsubmitted that courts below have not appreciated the prima facie<br \/>\nmaterial with regard to medical certificate as well as death<br \/>\ncertificate issued by Ahmedabad Municipal Corporation and hard fact<br \/>\nremain that the deceased expired in the hospital of the accused and<br \/>\nthe courts below ought to have held the accused guilty of the offence<br \/>\nof deposing falsely on oath.   It is further submitted that the<br \/>\nconsideration weighed with the courts below is time gap of the<br \/>\ncomplaint filed after several days and nothing could have come in way<br \/>\nfor the complainant to secure justice.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned counsel for the petitioner and learned APP for<br \/>\nrespondent-State, it transpires that submissions canvassed by learned<br \/>\ncounsel for the petitioner with regard to powers under Section 202 of<br \/>\ninitiating inquiry by the learned Magistrate and rejection of<br \/>\ncomplaint later on cannot be accepted inasmuch as when after ordering<br \/>\nthe inquiry under Section 202 of the Code, learned Judge has<br \/>\nultimately noticed that when the complaint is barred under Section<br \/>\n195 (1) (b) (i) (ii) (iii) of the code, the learned Magistrate was<br \/>\nempowered to pass the order under Section 203 of the Code.  It is to<br \/>\nbe noted that Section 195A is inserted by Act 5 of 2009 w.e.f.<br \/>\n31.12.2009 which empowers the witness or any other person to file a<br \/>\ncomplaint in relation to an offence under Section 195A of the Indian<br \/>\nPenal Code and it is trite that any amendment introduced in the Penal<br \/>\nconstitute cannot have a retrospective effect.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe above aspect, other submissions on merit will have no relevance<br \/>\nand the order of learned Magistrate is confirmed by well reasoned<br \/>\norder of learned Sessions Judge while exercising revisional<br \/>\njurisdiction, I do not find any substantial question of law or any<br \/>\nmiscarriage of justice in the orders passed by the Courts below<br \/>\nwarranting to exercise extra ordinary jurisdiction under Articles 226<br \/>\nand 227 of the Constitution of India read with Section 482 of the<br \/>\nCode keeping it open to the petitioner to take remedy in accordance<br \/>\nwith law.\n<\/p>\n<p>7.\tThis<br \/>\npetition is dismissed.
