\nTribunal, Ba.nlgal,orel ._B.;1ngaiore, {he1’einafter, referred<\/p>\n
to as the l’d’l”ribur1ai–.’},Arbeiiibg aggrieved by the order dated<\/p>\n
  the application filed by t.he<\/p>\n
 lreslporident-piaintiff has been disposed of by setting asicie<\/p>\n
the  V18\/6\/2002 at Annexure ‘A– 1.9’ and directing<\/p>\n
 the respaoridents in the application, i.e., the petitioners<\/p>\n
it l..fhere’i:n not to recover the amount proposed in the impugned<\/p>\n
—   and the amount if any, recovered from the applicant<\/p>\n
 wconseqtient on the process of recovery initiated by the<\/p>\n
respondents be refunded to him. It is also ordered that the<\/p>\n

applicant. would not be entitled to the pay scale of<\/p>\n

a mistake in fixing the pay scale”o;f’the petitiorre1\u00a7’.inlV'”t.lheHseale
\nof Rs.14oo-40-18oo\u00ab5o–2.s_o0 .a’:’:’ci”i_jt}ie>_gaid was
\nrectified and wherefore,’24″he_”\\vasfV;’l1lab2taV:_pay a sum of
\nRs.86.164\/–   the month of<\/p>\n
July 2002 as-   pay slip of July 2002.\n<\/p>\n
 Itiis’  of  applicant that his pay
\nwas fixedin the seyalefotiRs$’1?OO–204O on 8\/6\/1987. As he<\/p>\n
had produced”a_:Vcerti\ufb01catel”tor having passed the qualifying<\/p>\n
‘2 0’ ‘e.?<an1in'at_i011  zwhich" "" "enabled him to three advance<\/p>\n
 pay scale of Rs. .1 400-2300 was \ufb01xed.\n<\/p>\n
“.l’h.e’ pay  the said promoted post has also been fixed<\/p>\n
‘and there was no mistake in fixing the pay scale and in any

u\ufb02application was resisted by the petitioners by contending<\/p>\n
that there was a mistake while fixing the pay scale and the
\nsame has been recovered  it was found that certain salary<\/p>\n

\nsalary has been fixed in the promotional post on the basis of<\/p>\n
the said pay scale.\n<\/p>\n
4\u00bb. The Tribunal after considering the <\/p>\n
the learned counsel appearing for the parties\ufb01iilplielldvi’lutl1e_l:’ M<\/p>\n
contentions of the petitioners herein-‘in’ so ‘far as_,.itl 1=elated}tol’v-.<\/p>\n
refixing of the salary. However, <\/p>\n
already paid shall not be recoyer_ed_as  iniistake
\non the part of the applicant as  rendered  to the
\nsatisfaction of the petitioners.ai1;df’;.ass  a mistake on
\nthe part of the recovery would<\/p>\n

6. Learned counsel appearing for the petitioners<\/p>\n
contended that the ‘l’ribunal held that there was a mistake in<\/p>\n
ig\u00e9gg<\/p>\n

fixing the pay scale and having accepted the same,___ the<\/p>\n
quashing of recovery of the amount was not justified<\/p>\n

7’.  -v.._furth:e_’1′ Hsubrnitted that the
\ntribunals..0rders_V”isl*–J;iable_jltoivbe ‘:–3.etH_alside as it is erroneous
\nand the:7petit:ioners’:’are  to recover the excess salary
\npaid to them which rnistake and said mistake has
\n  tln-.4vAresponse to the arguments of the learned<\/p>\n
eourisel  petitioners. learned cousnel for the<\/p>\n
V _ respondent’submitted that there was no mistake on the part<\/p>\n
 the respondent’.. He had produced the certificate and the<\/p>\n
  of the certificate was not disputed and it was<\/p>\n
‘:l_”aceepted and therefore. he was entitled to three advance<\/p>\n
it  increments and hence, there was no mistake on the part of<\/p>\n
the respondent. However. the Tribunal has up held the<\/p>\n
rectification of mistake but has rightly directed that the<\/p>\n
arnount already paid shall not be recovered and if a1I1otn1t’~i..5<\/p>\n
already recovered. it shall be refunded on the  t.<\/p>\n
impugned order. In support of his coritentioiif’l’1e:has’=re1.ied.V <\/p>\n

scrutinized the” Arriaterial on record in the light of the<\/p>\n
  lprineilpluesllaiddyown by the Hon’ble Supreme Court.<\/p>\n

‘by the learned counsel for the respondent, which is a later<\/p>\n
ll_d,ecisi-on  the case K.Vasudeuan Hus; Mohan N.MaIi and<\/p>\n
..llo’.-O’t’i*tersA, supra, it is clear that even where Wrongful promotion<\/p>\n
” ‘has been rectified, question of recovery of the excess amount<\/p>\n
paid would not arise and in the present case. it is not<\/p>\n
disputed that by order dated 8\/ 6\/ 1987. pay scale was fixed<\/p>\n

at Rs. 1400-2300 and thereafter. promotion was given” and<\/p>\n
consequently, pay scale was fixed on that basis. <\/p>\n
the petitioners found that there was a mistake  .<\/p>\n
said pay scale and the mistake hasbeen re_cti1″ie{:if,.,  it <\/p>\n
upheld by the Tribunal and the mere fact it<\/p>\n
upheld the rectification of the\u00bb’n1i_stakeyv’ouid the <\/p>\n
petitioners herein to recover  ‘atnotintilrpaid by
\nmistake as it is well settled in the decision of the
\nHon’ble Supreme Court  having regard
\nto the facts o\ufb02case  mistake on the
\npart of the   n’o\u00a7t=their case that a faise
\nrepreseajntatiloni.fiiad.lEt)leen:v’inade  the mistake was on
\nthe part’of the  and wherefore, the same<\/p>\n
was rectified _:and_.J– the Vlslame is not challenged by the<\/p>\n
‘ ‘  ..res’pondAent”h.ereinlaiidvit has become final. However, so far<\/p>\n
   already paid pursuant to the fixation of pay<\/p>\n
scale, SVi.7f.1′<i\u00e9:'1–V_ there was no mistake on the part of the<\/p>\n
lgresponderit and mistake was on the part of the petitioners<\/p>\n
 is permitted to be recti\ufb01ed the same is only<\/p>\n
prospective effect and accordingly, we find that the orders<\/p>\n
passed by the Tribunal impugned in this writ petition is<\/p>\n
justified and does not suffer from any error or illegality so as<\/p>\n
