JUSTICE JYOTI SARAN\n\n                 ORAL ORDER<\/pre>\n<p>                 (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p>6   25\/10\/2010               This Appeal preferred under Clause &#8211; 10 of the<br \/>\n                  Letters Patent arises from the judgment and order dated<br \/>\n                  28th June 2010 passed by the learned Single Judge in<br \/>\n                  CWJC. No.9696 of 2010.\n<\/p>\n<p>                             The appellants &#8211; writ petitioners are traders<br \/>\n                  dealing in distribution of medicines. They had borrowed<br \/>\n                  loan from the respondent &#8211; Canara Bank (hereinafter<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>referred to as \u201ethe Bank\u201f). The appellants failed to repay<br \/>\nthe loan as per the schedule. Indisputably, the appellants<br \/>\nare in arrears of re-payment of the loan amount. Indeed,<br \/>\nunder the orders of the court the appellants have paid<br \/>\ncertain amounts. However, they are still indebted to the<br \/>\nBank.\n<\/p>\n<p>          The appellants claim that the Bank be<br \/>\ncompelled to settle the account of the appellants under<br \/>\nthe settlement scheme (annexure -1 to the Appeal). The<br \/>\nlearned Single Judge has dismissed the writ petition.<br \/>\nTherefore, the present Appeal.\n<\/p>\n<p>          The Appeal is contested by Mrs. Sheela<br \/>\nSharma. She has submitted that the scheme (annexure -1<br \/>\nto the Appeal) is not applicable in case of the appellants.<br \/>\nMoreover, the appellants are willful defaulters. Their<br \/>\naccount, therefore, cannot be settled. In support of her<br \/>\nargument Mrs. Sharma has relied upon the Micro, Small<br \/>\nand Medium Enterprises Development Act, 2006. The<br \/>\nabove Act is enacted by the Government of India to<br \/>\nprovide for facilitating the promotion and development<br \/>\nand enhancing the competitiveness of micro, small and<br \/>\nmedium enterprises.      Under the said Act the word<br \/>\n&#8220;enterprise&#8221; is defined, inter alia, to mean an industrial<br \/>\nundertaking or a business engaged in the manufacture or<br \/>\nproduction of the     goods. The aforesaid definition is<br \/>\nexhaustive and does not include the trading business.\n<\/p>\n<p>           The Bank appears to have framed a scheme<br \/>\nfor one time settlement of doubtful and loss assets with<br \/>\ntotal dues of Rs.50.00 lacs and below in micro and small<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>         enterprises sector. The said scheme has been made<br \/>\n         applicable specifically to micro and small enterprises<br \/>\n         alone. It specifically excludes from its purview the cases<br \/>\n         of willful default, fraud and malfeasance.\n<\/p>\n<p>                   In our opinion, by its very nature the benefit<br \/>\n         under the scheme can be extended to a business engaged<br \/>\n         in manufacturing or production of goods alone and that<br \/>\n         too an industry specified      in First Schedule.     The<br \/>\n         appellants admittedly cannot be classified as either a<br \/>\n         micro or a small enterprise.\n<\/p>\n<p>                   The appellants are, therefore, not entitled to<br \/>\n         the benefit of the above one time settlement scheme.<br \/>\n         We, therefore, cannot issue a writ of mandamus upon<br \/>\n         the Bank calling upon it to settle the loan account of the<br \/>\n         appellants under the above referred scheme (annexure -1<br \/>\n         to the Appeal).\n<\/p>\n<p>                   The Appeal is dismissed in limine.\n<\/p>\n<p>                   Interlocutory Application no. 6539 of 2010<br \/>\n         stands disposed of.<\/p>\n<pre>\n\n                                 ( R.
