Justice R.BASANT\n\n Dated :19\/12\/2006\n\n O R D E R\n                              R.BASANT, J.\n\n                     ------------------------------------\n\n                     Crl.R.P.NO. 1755 OF 2004\n\n                     ------------------------------------\n\n            Dated this the 19th day of  December, 2006.\n\n\n                                 ORDER\n<\/pre>\n<p>      This   Revision   Petition   is   directed   against   a   concurrent<\/p>\n<p>verdict   of   guilty,   conviction   and   sentence   imposed   on   the<\/p>\n<p>petitioner  in a prosecution under Section 138 of the Negotiable<\/p>\n<p>Instruments   Act.     The   respondent   has   also   entered   appearance<\/p>\n<p>through counsel.\n<\/p>\n<\/p>\n<p>      2.    When   this   revision   petition   came   up   for   hearing,   the<\/p>\n<p>learned   counsel   for   the   petitioner   and   the   respondent   have<\/p>\n<p>submitted that the matter has been settled amicably between the<\/p>\n<p>parties.   They have filed a joint application for composition duly<\/p>\n<p>signed   by   the   rival   contestants   and   counter   signed   by   the<\/p>\n<p>respondent&#8217;s   counsel.            The   learned   counsel   for   the<\/p>\n<p>respondent\/complainant vouches that the signature appearing in<\/p>\n<p>the application for composition is that of the complainant.<\/p>\n<p>      3.    The   offence   punishable   under   Section  138   of  the   N.I<\/p>\n<p>Act is now compoundable after amendment to the N.I Act.  I am<\/p>\n<p>satisfied, from the submissions made by the counsel as also the<\/p>\n<p>joint statement filed by them, that the parties have settled their<\/p>\n<p>dispute amicably.  I find no reason not to accept the composition.<\/p>\n<p><span class=\"hidden_text\">Crl.R.P.No.1755\/04                      2<\/span><\/p>\n<p>The   composition   can   now   be   accepted   and   granted   requisite<\/p>\n<p>leave under Section 320(6) Cr.P.C.\n<\/p>\n<\/p>\n<p>       4.      In the result:\n<\/p>\n<\/p>\n<p>       i)      Crl.M.A.No.12887   of   2006   is   allowed   and   the<\/p>\n<p>composition is accepted after granting the requisite leave;<\/p>\n<p>       ii)     The   acceptance   of   the   composition   shall   have   the<\/p>\n<p>effect of acquittal of the accused of the offence punishable under<\/p>\n<p>Section 138 of the N.I Act as stipulated under Sec.320(8) of the<\/p>\n<p>Cr.P.C;\n<\/p>\n<\/p>\n<p>       iii)    This   revision   petition   is   accordingly   allowed.     The<\/p>\n<p>impugned   judgments   are   set   aside.     The   bail   bond   executed  by<\/p>\n<p>the accused shall stand discharged and he is set at liberty.<\/p>\n<p>       5.      It is submitted that an amount of Rs.21,834\/- (Rupees<\/p>\n<p>twenty   one   thousand   eight   hundred   and   thirty   four   only)   is   in<\/p>\n<p>deposit   before   the   learned   Magistrate.   Both   counsel   pray   that<\/p>\n<p>the   said   amount   may   be   directed   to   release   to   the<\/p>\n<p>accused\/revision petitioner herein.
