WADHWA.\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n\t\t  THE 5TH DAY OF MAY, 1997<br \/>\nPresent,<br \/>\n\t       Hon&#8217;ble Mr. Justice K. Ramaswamy<br \/>\n\t       Hon&#8217;ble Mr. Justice D.P.Wadhwa<br \/>\nA.S. Sohal, Adv. for R.S. Sodhi, Adv. for the  appellants.\n<\/p>\n<p>\t\t\t O R D E R<br \/>\nThe following order of the Court was delivered:\n<\/p>\n<p>     Though all\t steps have been taken to ensure the service<br \/>\nof  notice,  the  respondent  could  not  be  contacted\t for<br \/>\nservice.   Even the  last know\taddress was tapped to effect<br \/>\nthe service; but  that has also proved abortive. Under these<br \/>\ncircumstances, notice must be deemed to have been served.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     The respondent,   who  was a  Constable in\t the  police<br \/>\nservice of  the state of Punjab,  absented himself from duty<br \/>\nfor a  long period,  i.e., from November 7, 1986 to March 1,<br \/>\n1988, without  any leave.   As a result, disciplinary action<br \/>\nwas conducted.\t The  disciplinary authority on the basis of<br \/>\nfinding of dereliction\tof non-reporting for duty, dismissed<br \/>\nhim from  service. The\tci trial  court dismissed  the\tsuit<br \/>\nfiled by  the respondent.   On\tappeal, the  first appellate<br \/>\nCourt\tremanded the   matter  for   reconsideration  by the<br \/>\ntrial court on the point of punishment.\t The  High Court has<br \/>\ndismissed the  Second Appeal  No. 155\/96  summarily  by\t its<br \/>\njudgment and  order dated  August  21,\t1996.\t Thus,\tthis<br \/>\nappeal by special leave.\n<\/p>\n<p>     The  appellate court recorded the finding as under:<\/p>\n<p>     &#8220;I have  gone   through the   above<br \/>\n     authorities   and\t  am   of    the<br \/>\n     considered opinion\t  that\talthough<br \/>\n     the  plaintiff\twas   admittedly<br \/>\n     guilty of\tmisconduct in  absenting<br \/>\n     himself but misconduct could not be<br \/>\n     classified as  the gravest\t act  of<br \/>\n     misconduct within\tthe  meaning  of<br \/>\n     the  sub-rule.\tThe   contention<br \/>\n     appears to\t be well-founded.  It is<br \/>\n     true that,\t generally speaking,  it<br \/>\n     is for  the punishing  authority to<br \/>\n     determine\t the\tseriousness   of<br \/>\n     punishment and it is not within the<br \/>\n     ambit of  the powers  of this Court<br \/>\n     to interfere with the direction  of<br \/>\n     the authority.  But then there rule<br \/>\n     and that  is that\tthe  court  will<br \/>\n     strike down  an order    which  has<br \/>\n     been     passed  illegal  only  and<br \/>\n     arbitrarily. In  the present  case,<br \/>\n     it was  incumbent on the punishment<br \/>\n     of dismissal,  to come to a finding<br \/>\n     that the  misconduct attributed  to<br \/>\n     the respondent  was a  &#8216;gravest act<br \/>\n     of misconduct&#8217;.   It  is  true that<br \/>\n     in\t the   context\tin   which  that<br \/>\n     expression is used it does not mean<br \/>\n     an act  of misconduct  and means,on<br \/>\n     the other\thand, an  act denoting a<br \/>\n     very high\tdegree of  misconduct as<br \/>\n     opposed to a merely grave or a very<br \/>\n     grave act\tof misconduct.\tBut then<br \/>\n     it appears that the defendants when<br \/>\n     awarding\tthe punishment\twere not<br \/>\n     alive to the provisions of the sub-<br \/>\n     rule otherwise  he would  not  only<br \/>\n     not have  awarded the punishment of<br \/>\n     dismissal\twithout\t  coming  to   a<br \/>\n     finding   that    the    misconduct<br \/>\n     attributed to the respondent was of<br \/>\n     the Gravest  type but  would at all<br \/>\n     for the reasons that the misconduct<br \/>\n     even though  grave was  not of  the<br \/>\n     Gravest type.   The lack of finding<br \/>\n     about the\tmisconduct being of thre<br \/>\n     requisite tupe  makes the\timpugned<br \/>\n     order  arbitrary\tin  nature  and,<br \/>\n     therefore, liable to be quashed.&#8221;<br \/>\n     It is  settled  legal  position  that  it\tis  for\t the<br \/>\ndisciplinary authority\tto pass appropriate punishment;\t the<br \/>\ncivil Court  cannot substitutte\t its own view to that of the<br \/>\ndisciplinary as\t well as  appellate  authority on the nature<br \/>\nof the\tpunishment  to\tbe  imposed  upon  the\t  delinquent<br \/>\nofficer.   In view  of the   finding  of the appellant Court<br \/>\nthat it is a grave misconduct, the appellate Court ought not<br \/>\nto have\t interfered with the decree of the trial Court.\t The<br \/>\nHigh Court  dismissed it without application of the mind and<br \/>\nignoring the settled legal principles.\n<\/p>\n<p>     The appeal\t is accordingly\t allowed.
