Aggarwal, J.   <\/p>\n<p> 1. Satish Chander Gupta, hereinafter described as<br \/>\nthe petitioner has filed the petition for grant of<br \/>\nprobate of the will dated 30th October, 1981 of Mrs.<br \/>\nBishan Devi or in the alternative for grant of Letters<br \/>\nof Administration pertaining to the will referred to<br \/>\nabove.\n<\/p>\n<p> 2. The facts alleged are the Mrs. Bishan Devi,<br \/>\nwho was governed by the Mitakhara School of Hindu Law<br \/>\ndied at Delhi on 2nd January, 1988. She had executed<br \/>\nher last will at Delhi on 30th October, 1981 in<br \/>\npresence of two witnesses, namely Hemlata and Rajiv<br \/>\nGupta. At that time, she was in full possession of<br \/>\nher mind and senses. Respondents 2 to 6 are the sons<br \/>\nand daughters of the deceased. In addition to that<br \/>\nKailash Chandra and Ramesh Chandra, her two sons had<br \/>\npre-deceased her. Respondents 7 to 13 are the<br \/>\nchildren of the said pre-deceased sons of Mrs. Bishan<br \/>\nDevi. It is the claimed that because of the said will<br \/>\napplicant is entitled to administer the estate of the<br \/>\ndeceased Bishan Devi. Hence the present petition.\n<\/p>\n<p> 3. Contest has been offered basically by<br \/>\nrespondents 3 and 7 to 10. They had denied the<br \/>\nexecution of the said will while respondents 2,4,5,<br \/>\n6, 10,11, 12 and 13 had filed their no objection for<br \/>\ngrant of the probate.\n<\/p>\n<p> 4. On 25th January, 2001 this court had granted<br \/>\nlast opportunity to respondent no. 3 to be examined as<br \/>\na witness but on payment of Rs. 10,000\/- as costs. But<br \/>\non 10th July, 2001 there was no appearance on behalf<br \/>\nof either of the respondents hence they were proceeded<br \/>\nex parte.\n<\/p>\n<p> 5. Keeping in view the pleadings of the parties on<br \/>\n26th October, 1993 this court had framed the following<br \/>\nissues:-\n<\/p>\n<p> 1(a) Whether Smt. Bishn Devi executed a<br \/>\nwill in favor of the petitioner on<br \/>\n20.10.1981 as alleged in para no. 3 of the<br \/>\npetition?\n<\/p>\n<p> 1(b) If so, whether the same is legally and<br \/>\nvalidly executed will.\n<\/p>\n<p> 2. To what relief, if any, the petitioner<br \/>\nis entitled?\n<\/p>\n<p> 6.   Issues 1(a) and 1(b)  : Both the issues are<br \/>\ninter connected and therefore can conveniently be<br \/>\ntaken up together. In support of these issues, the<br \/>\npetitioner examined Ms. Hemlata. She stated that<br \/>\ndeceased Bishan Devi was the sister of her father.<br \/>\nShe had executed a will Ex. PW1\/1. The witnesses<br \/>\nadded that she had signed this will as an attesting<br \/>\nwitness in the presence of Bishan Devi at point &#8216;B&#8217;.<br \/>\nRajiv Gupta had also signed the will. First of all it<br \/>\nwas Bishan Devi who had signed the will. The witness<br \/>\nwas cross-examined but it cannot be termed that by<br \/>\nvirtue of cross-examination the testimony of the<br \/>\nwitnesses had been shaken. In this process will must<br \/>\nbe held to have been duly proved. There is no other<br \/>\nevidence on the record to indicate that the will can<br \/>\nbe termed to be bogus or sham or it was not validly<br \/>\nexecuted. Issues therefore are decided in favor of<br \/>\nthe petitioner.\n<\/p>\n<p> 7. For these reasons recorded above the petition<br \/>\nis allowed and petitioner is granted probate of will<br \/>\ndated 30th October, 1981 purported to have been<br \/>\nexecuted by Bishan Devi. In other words the petition<br \/>\nis allowed.
