Justice M.SASIDHARAN NAMBIAR\n\n Dated :31\/10\/2006\n\n O R D E R\n                  M.SASIDHARAN NAMBIAR,J.\n\n                  ------------------------------------------\n                  W.P.(C) .NO.28558   OF  2006\n                  ------------------------------------------\n\n                  Dated     31st    October   2006\n\n                              JUDGMENT\n<\/pre>\n<p>      Petitioner is challenging Ext.P7 order whereunder<\/p>\n<p>trial   court   directed   petitioner   to   produce     document<\/p>\n<p>as   sought   for   by   plaintiffs   in   Ext.P5   application.<\/p>\n<p>Contention   of   petitioner   is   that   documents   sought   to<\/p>\n<p>be   produced     are   several     and   they   are   not   relevant<\/p>\n<p>documents and some of the documents are not available<\/p>\n<p>and in such circumstances the order is to be quashed.<\/p>\n<p>Exercising   extra   ordinary   jurisdiction   of   this   court<\/p>\n<p>under Article 227   of Constitution of India, I do not<\/p>\n<p>find that   any interference is called for with regard<\/p>\n<p>to   the   direction   to   produce   documents.   If   the<\/p>\n<p>grievance   of   petitioner   is   that   petitioner   is   not   in<\/p>\n<p>possession   of   documents,   petitioner   can   file   an<\/p>\n<p>affidavit   to   that   effect.   If   grievance   of   petitioner<\/p>\n<p>is   that,   adverse   inference   will   be   drawn,   adverse<\/p>\n<p>inference  can  only  be   drawn  if  those  documents    are<\/p>\n<p>material   and   relevant   for   deciding     the   case   and   are<\/p>\n<p><span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>in   the   custody   and   control   of   petitioner.   If   the<\/p>\n<p>documents are   not relevant or necessary   or are not<\/p>\n<p>in custody of petitioner, then the  court cannot draw<\/p>\n<p>any   adverse   inference   against   petitioner.
