With the consent of the parties, the matter is<br \/>\ntaken up for hearing today.\n<\/p>\n<p>2.0\tBy<br \/>\nway of this petition, the petitioner has prayed to quash and set<br \/>\naside the impugned award dated 17.02.2010 passed by the learned<br \/>\nPresiding Officer, Labour Court, Kachchh at Bhuj in Reference<br \/>\n(L.C.B.) Case No. 118 of 2000 whereby the Labour Court has allowed<br \/>\nthe Reference and directed the petitioner to reinstate the<br \/>\nrespondent-workman on his original post from the date of his<br \/>\nretrenchment with continuity of service along with 25% back wages.\n<\/p>\n<p>3.0\tThe<br \/>\nshort facts of the case are that the respondent-workman  was serving<br \/>\n as   Labourer with the Gujarat Maritime  Board, Mandvi since 1981.<br \/>\nHe used to earn  wage of Rs.2208\/.- As and when there was work he was<br \/>\ncalled for work. Later on as there was no work, the petitioner<br \/>\nretrenched the respondent workman from service w.e.f. 18.01.2000.<br \/>\nPursuant to the removal from service by the petitioner, the<br \/>\nrespondent workman raised an industrial dispute, which was referred<br \/>\nto the Labour Court, for adjudication, being  Reference (L.C.B.) Case<br \/>\nNo. 118 of 2000.  Before the Labour Court, both the parties adduced<br \/>\nthe evidence and after appreciating the material produced before it,<br \/>\nthe Labour Court allowed the Reference and passed the impugned award<br \/>\nas aforesaid.  Hence, this petition.\n<\/p>\n<p>4.0\tHeard<br \/>\nthe learned advocates for the respective parties and perused the<br \/>\ndocuments on record.  It  appears from the record that the petitioner<br \/>\nhas retained the workers junior to the respondent-workman and removed<br \/>\nthe respondent from the services.  It is required to be noted that<br \/>\nthe petitioner has not produced the entire service record of the<br \/>\nrespondent,  to show that the respondent had worked only for<br \/>\nparticular days in a year.  It is also recorded that while removing<br \/>\nthe respondent workman from service, the petitioner had not given any<br \/>\nnotice, notice pay or retrenchment compensation.  There is also clear<br \/>\nfinding that there is violation of provisions of Sections 25(F),<br \/>\n25(G) and 25 (H) of the Industrial Disputes Act.   The learned<br \/>\nadvocate for the petitioner is unable to point out anything contrary<br \/>\nto the said findings of the Labour Court.  Therefore, I am of the<br \/>\nview that the Labour Court has rightly passed the award qua<br \/>\nreinstatement.\n<\/p>\n<p>5.0\tSo<br \/>\nfar as 25% back wages is concerned, the Labour Court has not given<br \/>\nany cogent reasons for awarding back wages to the respondent-workman.<br \/>\nThe Apex Court in the case of <a href=\"\/doc\/800069\/\">Ram Ashrey Singh v. Ram Bux Singh<\/a><br \/>\nreported in (2003) II L.L.J. 176 held that a workman has no<br \/>\nautomatic entitlement to back wages since it is discretionary and has<br \/>\nto be dealt with in accordance with the facts and circumstances of<br \/>\neach case. Similar principle has been laid down by the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/1628125\/\">General Manager, Haryana Roadways v. Rudhan Singh<\/a><br \/>\nreported in J.T. 2005(6) SC 137 [2005(5) SCC 591], wherein it<br \/>\nhas been held that an order for payment of back wages should not be<br \/>\npassed in a mechanical manner but a host of factors are to be taken<br \/>\ninto consideration before passing any such order.\n<\/p>\n<p>6.0\tIt<br \/>\nwould also be relevant to refer to a decision of the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/109156\/\">A.P. State Road Tranport &amp; Ors. v. Abdul Kareem<\/a><br \/>\nreported in (2005) 6 SCC 36, wherein it has been held that a<br \/>\nworkman is not entitled to any consequential relief on reinstatement<br \/>\nas a matter of course unless specifically directed by forum granting<br \/>\nreinstatement. In above view of the matter, I am of the opinion that<br \/>\nthe respondent cannot be said to be entitled for back wages.\n<\/p>\n<p>7.0\tIn<br \/>\nthe result, the petition is partly allowed. The impugned award qua<br \/>\nback wages is quashed and set aside. The award qua reinstatement is<br \/>\nconfirmed. Since the reinstatement is granted on the basis of<br \/>\nviolation of provisions of Sections 25(F),  25(G) and 25(H) of the<br \/>\nI.D. Act, the respondent workman will be given the benefit of<br \/>\ncontinuity of service and such other benefits, as per the Rules<br \/>\nprevailing in the petitioner Board. The petitioner is directed to<br \/>\nreinstate the respondent-workman on 01.09.2010 and will release the<br \/>\nconsequential benefits within a period of one month thereafter. The<br \/>\naward of the Labour Court is modified accordingly. Rule is made<br \/>\nabsolute to the aforesaid extent with no order as to costs.
