 compensation against the impugned judgment and<\/p>\n
award dated 1I.8.2005 assed in MVC NO.4757\/2001

\nMetropolitan area, Bangalore (SCCH–17), [hereinafter<\/p>\n
referred to as ‘Tribunal’ for short).<\/p>\n
2. By its judgement and award, the Tribunaidiias\u00e9<\/p>\n
awarded a sum of $220,000\/~ with interestxeit  <\/p>\n
from the date of petition till reaiisation ‘as:<\/p>\n
claim made by the appeliant for  of <\/p>\n
on account of the injuries su’;-stainedby_her:.’in\ufb02”t:hVe”road
\ntraffic accident. Beinggaggrietfedii}:-tfthe  judgment<\/p>\n
and award, the appellant  this appeal<\/p>\n
seeking  I ground that. the amount
\nawarded by! the  inadequate.\n<\/p>\n
 ‘In\u00bbbrief,”‘ the facts of the case are:<\/p>\n
   claims to be aged about 35 years. a<\/p>\n
  in M.S.Ramaiah I-iospitai, getting<\/p>\n
‘V sa1ar3r..of\u00a715,OOO\/– p.m., after deducting profession tax<\/p>\n
 income tax. She was hale and healthy prior to the<\/p>\n
‘   That, at about 9.20 am. on 14.5.2001, when<\/p>\n
 was driving the Marathi car bearing No.KAO4–N–<\/p>\n
2897 on C.V.Rama% road, near Indian Institute of<\/p>\n

Science Main gate, at that time, a water tanker bearing
\nN0.KA–l7–3828, driven by its driver in high speed and<\/p>\n
in a rash and negligent manner, Came from oppolsite<\/p>\n
direction and dashed against the Maruthi ca:’;”‘*iD.f_ale_l’ito:4_ _<\/p>\n
which, the appellant sustained grieyous   it  <\/p>\n
car was totally damaged. Immediately,,lshe’–yifa.s”‘take-n <\/p>\n
M.S.Rarnaiah hospital, Bang.alore,’~._ yvherej’si*ieVV <\/p>\n
treatment for about 2 monthsand   inpatient,
\nand undergone a surgeI–‘y’.g71’ll2e  examined the
\nappellant has _i’–stated”‘ “that ”  it disability of<\/p>\n
shortening :i’owerT’iimb by 1 cm and as a result of<\/p>\n
Which,  disability to the extent of<\/p>\n
 23%.,\u00a7,ggTa}:ing all  factors, the appellant filed a claim<\/p>\n
   the Tribunal claiming compensation<\/p>\n
 reslpondents. The said claim petition had<\/p>\n
.q come upvgforllllconsideration before the Tribunal, which in<\/p>\n
 ll,ftur”Ii,n after hearing both sides and after assessing the<\/p>\n
   documentary evidence, has allowed the said<\/p>\n
it  petition in part and awarded a sum of ?3,10,0GO\/~<\/p>\n
as compensation uncigifferent heads with interest at<\/p>\n

\n6% p.a., from the date of petition till the date of<\/p>\n
realisation. Being aggrieved by the said judgment and
\naward, the appellant has presented this appeal, sgeehlting<\/p>\n
enhancement of compensation.\n<\/p>\n
4. The learned senior counsel appea.r.iriglfr.\u00a7:r._tng”‘  <\/p>\n
appellant submitted that the Tribunaiclgghalsg  .l<\/p>\n
awarding just and reasonab-ie conipensat.ion5 .t_owa_irds <\/p>\n
pain and suffering, conveyance,\u00bb nourishing food and
\nattendant charges, loss Vfof’ ‘amjeni’t*ie’sQdisconiforts and
\nunhappiness and loss.-of.fi1ture:_ine’oIrie.”on account of<\/p>\n
the injuries  the appellant in the road<\/p>\n
tra\ufb01ic accident. Te’ stiihsltantiate his submission that<\/p>\n
 the , fifrlbiinal  not awarded compensation towards<\/p>\n
 ‘of income, he has relied upon the judgment<\/p>\n
aim  Court in Civil Appeal No.’7223\/2010,<\/p>\n
–V arising  of SL1′ (Civil) No.1827\/2010, dated<\/p>\n
 ;a_20li0 (Yadava Kurnar — Vs \u00bb– The Divisional<\/p>\n
 Manager, National Insurance Co.Ltd 8: Another] and<\/p>\n
it submitted that the Apex Court has held that, if grievous<\/p>\n
injuries are sustag, the court must consider<\/p>\n

regarding granting of compensation towards loss of<\/p>\n
future income based on the percentage of disability<\/p>\n
suffered and not the occupation which the   V<\/p>\n
doing earlier.\n<\/p>\n
5. As against this, the 1e;a1\u00a5:iec1\u00ab <\/p>\n
third respondent~insurer, _intera’iia;’-._ contendect and V’<\/p>\n
substantiated the judgment the
\nTribunal as just and this
\nCourt is not called for_a_s’,’ assessing
\nthe oral and   taking into
\nconsiderationpw’ithe.,_age”arid__ occupation of the appellant,
\nhas  reasonable compensation.\n<\/p>\n
  I-Ie  ~ submitted that reasonable<\/p>\n
 .compen’sation..,, as per law, may be awarded towards<\/p>\n
coIi1reya11c’e–._ nourishing food and attendant charges and<\/p>\n
-V loss” of amenities, discomforts and unhappiness.<\/p>\n
 ‘::e\u00bb..F’urther: as the Tribunal has not awarded any<\/p>\n
 compensation towards future medical expenses,<\/p>\n
“”V.V.r’easonabIe compensation may be awarded under the<\/p>\n
said head also, in accordance with law.<\/p>\n

7. However, he vehemently submitted that the
\nquestion of considering the compensation payable<\/p>\n
towards loss of future income on account of disability<\/p>\n
does not arise in the instant case as the appei1–ant__’__ha_s” <\/p>\n
been continued in service and has been pron1_otVed.:as_ an ”  <\/p>\n

canvassed on both   es  the material<\/p>\n
availablewon. Airiecord-“* and’-also the impugned judgement<\/p>\n
and award,_ the lpoints. _.ti1aL_. arise for our consideration<\/p>\n
are:–__<\/p>\n

  the Tribunal was justi\ufb01ed in not
\nawarding compensation towards loss of future
\n rt.-‘income’?\n<\/p>\n
9. Re. Point No.1 :– The appellant claims to be<\/p>\n
V aged about 35 years, working as an Asst. Professor in<\/p>\n
M.S.Ra1naiah Hospita , getting salary of \u20ac15,000\/~ p.rn.,
\nMWMM<\/p>\n
8<\/span><\/p>\n
after deducting profession tax and income tax. She has
\ntaken treatment for about 2 months and 12 days as<\/p>\n
inpatient and undergone a surgery. The docto.rV_vii’7ho<\/p>\n
examined the appellant has stated  _<\/p>\n
disability of shortening of right Iogvgerg 1imb”‘by*:i:   ”<\/p>\n
as a result of which, she has    <\/p>\n
to the extent of 23%. It is thegease  the  that <\/p>\n
due to the injuries sustained_..Ioyv.her in .th’e.1foa,d traffic
\naccident, she is not   carry on her
\nprofession effectively {as  prior to the<\/p>\n
accident  suffer the discomforts and
\nunhappinessii throu”ghou’t.i.nher life. She has to undergo<\/p>\n
one surgery forrernoval of implants inserted and<\/p>\n
  to _Viricou.r”e,Xpenses towards the tentative cost of the<\/p>\n
  incidental expenses. Taking these<\/p>\n
‘V aspe’Cts””.ginto consideration the nature, duration of<\/p>\n
 “‘..js*..tre’atifnent taken by the appellant, pain and agony<\/p>\n
‘  suffered by her and taking into consideration that she<\/p>\n
“”v.,mrnight have spent considerabie amount towards<\/p>\n
conveyance, nourishing food and attendant charges, we<\/p>\n

\nsufferings as against 315,000\/–, ?2\u20ac),0O0\/- towards
\nconveyance, nourishing food and attendant charges as<\/p>\n
against $15,000\/-, \u20ac30,000\/– (?15,ooo x 2II101’11’ri’.1′:-‘”\u00a7–V}V:VVtO.’44\u00a3g\u00a7’\\?_?:1.Vi’\u20aciS<\/p>\n
loss of income during treatment period as against  <\/p>\n
?’80,000\/– towards loss of amenities, <\/p>\n
unhappiness as against ?40,000\/Ppaiidi’<\/p>\n
future medical expenses, to the .end.sVof ‘j~us’tiee:. The”?<\/p>\n
Tribunal has awardedzjust  reasonable “compensation of<\/p>\n

 dated 31.8.2010 [Yadava Kumar —- Vs —- The Divisional<\/p>\n
Manager, National  ranC\u20ac Co. Ltd 53: Another) and<\/p>\n

submitted that the Apex Court has held that, if grievous
\ninjuries are sustained, the court must consider<\/p>\n
regarding granting of compensation payable <\/p>\n
loss of future income based on the percentage..<\/p>\n
disability suffered and irrespective\u00bb of tiie'”-occupa’tiVonu ‘*<\/p>\n
which the claimant was doing ear’i_ier;:””i .. :5 A<\/p>\n
11. However, the facts:__’in_ that ease”.are._’~enti–re1y <\/p>\n
different. The clajrnant therein”w..was ‘ a..paA1’_\u20ac’1ter by
\nprofession and on acco’un–t   ‘injuries sustained in
\nthe road traf\ufb01\u20ac::V’acci(j1ent’  V~toi”his permanent<\/p>\n
disability, __ he’d-‘is:_not’v.in-.,___a- position to continue his<\/p>\n
professionapand this.VA’1eIei{ant factor has been borne in<\/p>\n
_ minci\u00a7”byi.the  has held that, in the facts and<\/p>\n
  the case, the Tribunals and the High<\/p>\n
‘CourtsvV”}1V\u00e91_ve’*ptVo consider to compensate the claimant<\/p>\n
–V towardsripossi of future income. But, in the instant case,<\/p>\n
 ‘:j.as’irightiy pointed out by the learned counsel for the<\/p>\n
*  insurer, as the appellant has been continued in service<\/p>\n
it  promoted as an Asst. Professor, she will have been<\/p>\n
given promotional benefits which comprises of increase<\/p>\n

in her salary would go to ciearly indicate there is no loss
\nof income. Therefore, the question of loss of income<\/p>\n
does not arise. Taking this relevant factoijVo\u00bb.in.to<\/p>\n
consideration, we are of the considered view:”.t1’1’a_t~—..the___ _<\/p>\n
contention of the learned senior\u00bb couns’e\u00bb1-jlfthat he ” it<\/p>\n
appellant should be compensatedpitowaifds’  .’<\/p>\n
income cannot be accepted.\u00bban_d therefore,   <\/p>\n
the Tribunal was justified  not  any
\ncompensation towards loss’  fnftiire.’pinco.rne.\n<\/p>\n
12. Accordingly, Ztiie\u00bb afppvealtp_isl.’a1lowe’d in part and<\/p>\n
the  award passed by the<\/p>\n
TribunaiAin:t\u00bbwc’v.Na4?5’7c\/\u00e9loo1 dated 11.8.2005 stands<\/p>\n
 modiffpiedel,.  a: compensation of ?3,10,000\/\u00ab~ as<\/p>\n
  awarded by the Tribunal. The<\/p>\n
l’enh.anc’ed”_”_v\u00bbcotripensation comes to ?90,000\/– which<\/p>\n
–V carries interest at 6% p.a. from the date of the petition<\/p>\n

 The third respondentwinsnrer is directed to deposit<\/p>\n
  enhanced compensation of ?90,000\/– with interest<\/p>\n
at 8% p.a. from the die of petition till the date of<\/p>\n
