DENESAN, J.\n\n\n\n                 = = = = = = = = = = = = = = =\n\n                  W.P.(C) No. 31503 OF 2006 A\n\n                 = = = = = = = = = = = = = = =\n\n\n\n              Dated this the 28th November, 2006\n\n\n\n                          J U D G M E N T\n<\/pre>\n<p>        The petitioners belong to the category of Cooks in<\/p>\n<p>the Tribal Development Department.  Presently, they are<\/p>\n<p>working   in   the   hostel   attached   to   Model   Residential<\/p>\n<p>School,   Painavu.     Certain   serious   grievances   suffered<\/p>\n<p>by   the   petitioners   were   voiced   through   detailed<\/p>\n<p>representation   preferred   by   them   and   addressed   to   the<\/p>\n<p>3rd     respondent.        Ext.   P1   is   the   copy   of   that<\/p>\n<p>representation.  It was first submitted before the next<\/p>\n<p>higher   authority.                The   2nd     respondent   is   an<\/p>\n<p>intermediary   officer   and   therefore   Ext.   P1   was<\/p>\n<p>channelized   through   him.     In   the   normal   course   the   2nd<\/p>\n<p>respondent   is   not   expected   to   dispose   of   Ext.   P1   by<\/p>\n<p>passing   an   order   as   he   likes   because   Ext.   p1   is<\/p>\n<p>addressed   to   the   3rd  respondent   who   is   the   head   of   the<\/p>\n<p>department   and   who   alone   is   expected   to   consider   the<\/p>\n<p>grievances   highlighted   by   the   petitioners   in   Ext.   P1.\n<\/p>\n<p>But   what   transpired   was   that   the   2nd  respondent   felt<\/p>\n<p>that he is competent to give a reply to the petitioners<\/p>\n<p>and   straightaway   dealt   with   the   representation   as<\/p>\n<p>though it was addressed to him, spoke on the merits of<\/p>\n<p><span class=\"hidden_text\">WPC No. 31503\/2006                                 -2-<\/span><\/p>\n<p>the   matter   applying   his   subjective   thinking   on   the<\/p>\n<p>issues   and   then   decided   that   the   representation   need<\/p>\n<p>not be forwarded to the 3rd respondent.  He also stated,<\/p>\n<p>as   seen   from   Ext.   P2,   that   such   representations   shall<\/p>\n<p>not         be         received         by         the         1st     respondent-Senior<\/p>\n<p>Superintendent from the petitioners.\n<\/p>\n<p>       2.   Feeling   aggrieved,   this   writ   petition   has   been<\/p>\n<p>filed.\n<\/p>\n<p>       3.   I   have   heard   the   Special   Govt.   Pleader<\/p>\n<p>appearing   for   the   respondents.     Ex   facie,   the   stand<\/p>\n<p>taken by the second respondent appears to be arbitrary,<\/p>\n<p>highhanded   and   not   in   accordance   with   the   office<\/p>\n<p>procedure   expected   to   be   followed   by   the   officers   of<\/p>\n<p>government   departments.     It   was   neither   proper   nor<\/p>\n<p>competent   on   the   part   of   the   2nd  respondent   to   pass<\/p>\n<p>final   orders   on   Ext.   P1   or   to   direct   that   hereafter<\/p>\n<p>such   kind  of  representations  shall  not  be  received  for<\/p>\n<p>onward   transmission   to   the   Director   of   the   Department.\n<\/p>\n<p>Ext. P2 is therefore liable to be set aside.   I do so.\n<\/p>\n<p>There   shall   be   a   direction   that   Ext.   P1   shall   be<\/p>\n<p>forwarded   to   the   3rd  respondent   and   if   it   is   so   felt,<\/p>\n<p>the   2nd  respondent   can   make   his   own   remarks   about   the<\/p>\n<p>factual   aspects   referred   to   in   Ext.   P1.     However,   the<\/p>\n<p>final   decision   will   have   to   be   taken   by   the   3rd<\/p>\n<p><span class=\"hidden_text\">WPC No. 31503\/2006                  -3-<\/span><\/p>\n<p>respondent   who   shall   do   so   after   affording   an<\/p>\n<p>opportunity of being heard to the petitioners since the<\/p>\n<p>grievances   highlighted   are   in   connection   with   the   day-\n<\/p>\n<p>to-day   difficulties   experienced   by   the   petitioners   in<\/p>\n<p>the   matter   of   discharging   their   duties   and   other<\/p>\n<p>service   conditions.     Whether   the   service   conditions<\/p>\n<p>should   be   improved   or   not   is   also   a   matter   for   the   3rd<\/p>\n<p>respondent   to   consider   and,   if   so   required,   after<\/p>\n<p>getting   necessary   orders   from   the   4th             respondent-\n<\/p>\n<p>Government.\n<\/p>\n<p>        4.   Respondents   1   and   2   shall   therefore   forward<\/p>\n<p>Ext. P1 to the 3rd  respondent within two weeks from the<\/p>\n<p>date   of   receipt   of   a   copy   of   the   judgment.     The   3rd<\/p>\n<p>respondent   shall   consider   the   same   as   directed   above<\/p>\n<p>within   one   month   on   receipt   of   a   copy   of   the   judgment<\/p>\n<p>and pass appropriate orders.  The result of disposal of<\/p>\n<p>Ext.   P1   shall   be   communicated   to   the   petitioners<\/p>\n<p>immediately.\n<\/p>\n<p>                                                       K.K.
