A’._Vfor”enhancement of cgmpensation on the ground that,<\/p>\n

the compensation of 399.375\/– awarded in his favour as
\nagainst his claim for ?\u00b0O5.00 lakhs, is inadequate.<\/p>\n
2. The appellant claims to be aged about <\/p>\n
studying in Nursery and she was hale and  <\/p>\n
to the date of accident. That at about  on  <\/p>\n
04-2000, when the father of the ap-peeliiatiz-ti<\/p>\n
near the road, at that time; the appellant   ><\/p>\n
relatives house by crossing road to ‘ to her house,
\nafter crossing the  %.j_ptha’t.vpivti.:me, a Bus bearing
\nRegistration No;’\u00a3’N–32’\/’C—-:77V\u00a79.”earrie  Hospete circle
\nin a rterrifieiiip    “speed, in a rash and
\nnegligent manner’:.i’and.V_:Ei-a,sl1ed against the appellant and<\/p>\n
as aresultVthe’;–saine;'”she fell down and thereafter, the<\/p>\n
 V’  _  front \\2\\rhee’l’ of the bus stood on the right leg. As<\/p>\n
  same, the right leg was Crushed. The<\/p>\n
 Rivas immediately rushed to Magadi<\/p>\n
 nGovern.1ti1ent Hospital for treatment and a complaint was<\/p>\n
3. It is the case of the appellant that she was in-<\/p>\n
patient in the Hospital :for 33 days in two different<\/p>\n
\/ WMMM<\/p>\n
hospitals, during which period, her father has spent
\nconsiderable amount towards conveyance, nourishing<\/p>\n
food and attendant charges including medical vei\ufb01penses<\/p>\n
and other incidental expenses and she <\/p>\n
amputation of her right leg below knee. Doctor. <\/p>\n
has assessed disability in resii3,ect_-iiofi’l7’v\u00a3)”\/lb<\/p>\n
and in respect of Whole boid3r__Vat 50?\/'<5 andV'vthCg:re_for_e, <\/p>\n
has to be compensated reas_on'a,bi3z,<\/p>\n
4. On a’ccount'”of.,”the._injurie.s””sustained in the<\/p>\n
accident,   minor, represented by
\nher father, filed”then’clairn,-~petition under Section 166 of<\/p>\n
the_.Motor”Vlehicies’v. before the Tribunal, seeking<\/p>\n
 Acorripensat,ion loflmallvsum of 305.00 lakhs against the<\/p>\n
   said claim petition had come up for<\/p>\n
 before the Tribunal on 10th February<\/p>\n
 Z The Tribunal, after considering the relevant<\/p>\n
it griiaterial available on file and after appreciation of the<\/p>\n
 ” \u00bb—oral and documentary evidence, allowed the claim<\/p>\n
petition in part, awarding a sum of 399,375\/– with<\/p>\n

interest at 6% per annum from the date of petition till
\nthe date of realization. Being dissatis\ufb01ed with the
\nquantum of compensation awarded by the Tribu;na.l, the
\nappellant is in appeal before this <\/p>\n
enhancement of compensation.\n<\/p>\n
5. We have heard learned  if<\/p>\n
and learned counsel for-.__ Insurance ‘for*.<\/p>\n
considerable length of time.  _\n<\/p>\n
6. After hearirilg _lAearn_ec.1 ” ~c_ourisel for the parties<\/p>\n
and after perusal of .tl1-e.”award passed by<\/p>\n
Tribunal ‘ineludi5;fig tlie’originai’records placed before us,
\nwe are of. the VVieyJgth.at,44’t.’;1e occurrence of accident and<\/p>\n
the.resulta1’it inj’–urives”sustained by appellant are not in<\/p>\n
   igaisof not in dispute that she was aged<\/p>\n
  years and studying in Nursery. The<\/p>\n
‘l”1Tlbu:\u00a51??\u00a2l:,fA4_’.~’aft\u20ac1′ assessing the oral and documentary<\/p>\n
 up evidence available on \ufb01le, has rightly awarded<\/p>\n
if vgcornpensation of ?8,000\/~ towards medical expenses.<\/p>\n
–Hence, it does not call for interference.<\/p>\n
\ufb01n<\/p>\n
‘7. However, the Tribunal erred in not awarding
\nreasonable compensation towards other heads and<\/p>\n
further erred in not awarding any compensation<\/p>\n
towards loss of future income, future medical<\/p>\n
and loss of marriage prospects.\n<\/p>\n

assessed in respect of right leg and<\/p>\n
50% in r’espect,’,*oft’=wVh’ole body. The appellant, being<\/p>\n
 V’  .  on.ly’-5 yearsfat the time of accident, has to pull on<\/p>\n
   disability for the rest of her life and she<\/p>\n
canlnot  a normal girl and do the work as other<\/p>\n
 xgirlszofther age can do. in View of the injuries and the<\/p>\n
 -..’magnitude of disability at this young age, we feel that,<\/p>\n
 = …-de\ufb01nitely her marriage prospects are likely to be<\/p>\n
affected. Accordingly, ‘ng into consideration all the

above aspects, we re~deter1nine compensation by
\nawarding a sum of ?1,00,000\/– towards pain and<\/p>\n
sufferings as against ?40,000\/–; ?’10,000\/~ towards<\/p>\n
conveyance, nourishing food and attendant \u00abcharge-s;~ as<\/p>\n
against %1,375\/–; $75,000; towards 1oss__of–.:aInfenities;–d up <\/p>\n
discomforts, and unhappiness

8. Further, it is the  has not
\nawarded any    medical<\/p>\n
expenses, loss of futL1r\u20ac,_i11Ct}IIiaC “a”nd””-loss of marriage<\/p>\n
prospects;  to”_’ti1″e’V4nature of injuries, the<\/p>\n
youngvvage of  the nature and duration of<\/p>\n
treatment  the percentage of disability which she<\/p>\n
an,.,.,haS;….’t()i,,”eI1d1aE1’6 ‘tor””t}1e remaining part of her life, we<\/p>\n
  ?50,000\/~ towards future medical<\/p>\n
\/– towards loss of marriage prospects<\/p>\n
 a-sum of 31,12,500\/\u00ab (i.e. ?15,ooo\/\u00ab x ’15’ x<\/p>\n
  50,1190), taking the notional income of \u20ac15,000\/– per<\/p>\n
 -annuin, adopting inultipiier of ’15’ and accepting the<\/p>\n
V whole body disabiiity at as assessed by Doctor.<\/p>\n
9. In the light of the facts and circumstances of<\/p>\n
the case, as stated above, the appeal filed by_4va,pp:el-1_ant<\/p>\n
