M. SAHAI)<\/a><\/p>\n<p>1.\t\tWe<br \/>\nhave heard Mr K G Sukhwani, learned counsel for the petitioner and Mr<br \/>\nN J Shah, learned AGP appearing for the respondent No.1.  This<br \/>\npetition has been filed by the petitioner who is<br \/>\na registered &#8220;AA&#8221; Class Government Contractor carries on<br \/>\nbusiness as Engineers and Contractors and is also<br \/>\nhaving registration in special category building-I with the Public<br \/>\nWorks Department of Government of Gujarat.\n<\/p>\n<p>2.\t\tThe<br \/>\nfacts of the case in brief are that in response to the tender notice<br \/>\nNo. 20 for various construction works invited by the respondents, the<br \/>\npetitioner has submitted price bid on 15.3.2011. The last date for<br \/>\nsubmitting price bid was 18.3.2011which was extended twice and the<br \/>\nextended date was 26.4.2011. The price bid of other bidders were<br \/>\nopened on 26.4.2011 but the petitioner has not been selected in<br \/>\npreliminary stage evaluation and his price bid was not opened. This<br \/>\npetition has been filed with a prayer to quash and set aside the<br \/>\naction of the respondents in not selecting the tender of the<br \/>\npetitioner for work of construction of new building for Medical<br \/>\nCollege at Valsad and for a direction to the respondents to open the<br \/>\nprice bid of the petitioner for the  above work and consider his case<br \/>\nin accordance with law.\n<\/p>\n<p>3.\t\tIt<br \/>\nappears that the respondents had refused to consider the bid of the<br \/>\npetitioner as according to the respondents the petitioner is not<br \/>\nqualified to participate in the bid in view of the conditions of the<br \/>\ntender notice. A contractor has to produce necessary proof of<br \/>\neligibility criteria in the pre-qualification  submission and the<br \/>\ntenderer should have completed at least one project work of similar<br \/>\nnature having more than 40% of the estimated cost of the work during<br \/>\nthe last five financial years as prime contractor.  According to the<br \/>\npetitioner, the certificate issued by the Surat Municipal Corporation<br \/>\nwhich has been annexed at page No.315 of the petition shows that he<br \/>\nhad carried out the work of a project of Rs.2804.97 lacs including<br \/>\ncost of cement and steel worth Rs.1103.91 lacs which was provided by<br \/>\nthe Surat Municipal Corporation.  According to the respondents, cost<br \/>\nof steel and cement supplied by the Surat<br \/>\nMunicipal Corporation could not be added in the<br \/>\nestimated cost of the work carried out by the petitioner. If the cost<br \/>\nof cement and steel is reduced, it would be clear that the petitioner<br \/>\nhas not done the work having more than 40% of the estimated cost of<br \/>\nthe construction work and thus he was not qualified for the contract<br \/>\nfor construction of new building for Medical College at Valsad.   We<br \/>\nare of the opinion that the cost of cement and steel which was<br \/>\nsupplied by the Surat Municipal Corporation could not be added to the<br \/>\ncost of construction work done by the petitioner. Therefore, the<br \/>\nrespondents have rightly refused to open the price bid of the<br \/>\npetitioner.  We do not find any  illegality in the action taken by<br \/>\nthe respondents in not selecting the tender of the petitioner for the<br \/>\naforesaid work.\n<\/p>\n<p>3.<br \/>\nLearned counsel for the petitioner relies on precedent prevailing in<br \/>\nother States.  Every State has its own terms and conditions and<br \/>\nprocedures which cannot be applied to this case.\n<\/p>\n<p>4.\t\tIn<br \/>\nthe result, this petition is devoid of any merits and is accordingly<br \/>\ndismissed.
