APP for\nRespondent : 1, \nRULE SERVED for Respondent : 2, \nMR MD RANA for\nRespondent : 2, \n================================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/05\/2011 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>Original<br \/>\n\taccused no. 2 &amp; 3 in FIR No. I-591 of 2005 registered with<br \/>\n\tNavrangpura police station, Ahmedabad, have approached this Court<br \/>\n\tinvoking provision of Section 482 of Criminal Procedure Code for<br \/>\n\tquashing the same.\n<\/p>\n<p>Learned<br \/>\n\tadvocate for the petitioners as well as respondent no.2 bank, the<br \/>\n\tcomplainant, have submitted that the complaint be quashed as the<br \/>\n\tpetitioners were guarantors and the principal borrower who defaulted<br \/>\n\thas settled the entire claim of the bank, and now nothing would<br \/>\n\tsurvive.\n<\/p>\n<p>In<br \/>\n\tview of this, and in view of the fact that the narration in the<br \/>\n\tcomplaint also go to show that the bank could have pursued the claim<br \/>\n\tbefore appropriate civil forum, instead of filing complaint.<br \/>\n\tTherefore the complaint and the proceedings thereunder, in view of<br \/>\n\tthe statement made by learned advocate for the complainant is<br \/>\n\trequired to be quashed, and is accordingly quashed.
