Sodhi, Kuldip Singh, Advs. for the appellant<br \/>\nSudhir\tWalia,\t Adv.  for   Prem  Malhotra,  Adv.  for\t the<br \/>\nRespondent<br \/>\n\t\t      J U D G M E N T<br \/>\n     The following Judgment of the Court was delivered:<br \/>\nNanvati, J.\n<\/p>\n<p>     The State is challenging acquittal of the respondent in<br \/>\nthis appeal.\n<\/p>\n<p>     The respondent  was tried\tfor the\t murder of Kulwinder<br \/>\nSingh and  the trial  court relying  upon  the\tevidence  of<br \/>\nKulwinder Kaur- PW 5 and Gian Singh &#8211; PW 4 which proved that<br \/>\nthe accused  and the  deceased were last seen together and t<br \/>\nhe evidence of recovery of currency notes and wrist watch of<br \/>\nthe deceased,  on the  basis of\t a declaration\tmade by\t the<br \/>\naccused, held  him quality.  The appellant was convicted for<br \/>\nthe offence punishable under Section 302 IPC.\n<\/p>\n<p>     The High  Court held that Gian Singh was chance witness<br \/>\nand therefore it was risky to rely upon his evidence without<br \/>\nany corroboration.  The High Court also held that identiy of<br \/>\ncurrency notes\tand the\t wrist watch  was not established by<br \/>\nthe proesecution  beyond doubt\tand  therefore\tit  was\t not<br \/>\npossible to say that they belonged to the deceased. The High<br \/>\nCourt, therefore, acquitted the respondent.\n<\/p>\n<p>     After going  through the  evidence what we find is that<br \/>\nthe recovery  of money\tand the\t wrist watch stated to be of<br \/>\nthe deceased  were recovered by the Investigating officer in<br \/>\npresence of  Amar Singh\t &#8211; PW 10 &#8211; Maternal grandfather of t<br \/>\nhe deceased.  Thus, the\t recovery was not in presence of any<br \/>\nindependent person.  It was  for this  reason that  the High<br \/>\nCourt did  not think  it safe  to place\t any reliance on the<br \/>\nrecovery evidence.  The evidence  of PW\t 5 &#8211;  Kulwinder Kaur<br \/>\neven if\t believed only\testablishes that the accused and the<br \/>\ndeceased left  together at  5.00 p.m.  on 18.2.85. From that<br \/>\ncircumstance alone  no\tinference  can\tbe  drawn  that\t the<br \/>\nrespondent had committed the murder of Kulwinder Singh.\n<\/p>\n<p>     We therefore  see no  good reason to interfere with the<br \/>\nacquittal order\t passed by  the High  Court.
