Mehta appearing on behalf of appellant<br \/>\n?  G.S.R.T.C. and learned advocate Mr. Paresh M. Darji appearing on<br \/>\nbehalf of respondents.\n<\/p>\n<p>2.\tADMIT.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr. Darji waives service of notice of admission on behalf of<br \/>\nrespondents.\n<\/p>\n<p>4.\tIn<br \/>\nthe present appeal, the appellant ?  Corporation has challenged the<br \/>\naward passed by Motor Accident Claims Tribunal at Gandhinagar in<br \/>\nMotor Accident Claim Petition No.2007 of 2004 (Old No.2145 of 1996)<br \/>\ndated 22nd June 2006.\n<\/p>\n<p>5.\tThe<br \/>\nClaims Tribunal has awarded Rs.2,27,000\/- with 6% interest being a<br \/>\ncompensation.\n<\/p>\n<p>6.\tLearned<br \/>\nadvocate Ms. Mehta raised contention that this matter is not being<br \/>\nsettled in Lok Adalat and advocate of the Corporation is not agreed<br \/>\nin giving consent to settle the matter in Lok Adalat. She submitted<br \/>\nthat Corporation has received the letter from learned advocate Mr.<br \/>\nG.C. Mazmudar who had appeared on behalf of Corporation dated 30th<br \/>\nOctober 2006, where, in terms, it is mentioned that this matter has<br \/>\nbeen decided by the Claims Tribunal in his own way without obtaining<br \/>\nconsent from the advocate of the Corporation. There was no discussion<br \/>\nand advocate was not remained present and even it was not informed by<br \/>\nthe Claims Tribunal to the advocate and decided the matter as if that<br \/>\nCorporation is ready and willing to settle the matter in Lok Adalat.\n<\/p>\n<p>7.\tLearned<br \/>\nadvocate Mr. Darji submitted that a detailed reasonings are given by<br \/>\nthe Tribunal.  It is a fatal case. Even otherwise also, the amount<br \/>\nwhich has been awarded by the Tribunal comes to the same figure.<br \/>\nHowever, he submitted that when other side is objecting that there<br \/>\nwas no consent, then, this matter may go back with specific<br \/>\ndirections that Tribunal may decide this matter within some<br \/>\nreasonable time after giving reasonable opportunity of hearing to the<br \/>\nrespective parties.\n<\/p>\n<p>8.\tAfter<br \/>\nconsidering the submissions made by learned advocates appearing on<br \/>\nbehalf of respective parties and considering the reasonings given by<br \/>\nClaims Tribunal, where, specifically stated in last two lines of Para<br \/>\n6 that matter is decided before the Lok Adalat as per consent given<br \/>\nby the parties which was hand written. Probably, this has been<br \/>\nobjected by learned advocate Ms. Mehta. Therefore, just to clear the<br \/>\ndoubt as to whether matter has been settled in fact before the Lok<br \/>\nAdalat or not.\n<\/p>\n<p>9.\tTherefore,<br \/>\nthe award in question passed by Claims Tribunal, Gandhinagar in Motor<br \/>\nAccident Claim Petition No.2007 of 2004 (Old No.2145 of 1996) dated<br \/>\n22nd June 2006 is hereby quashed and set aside with a<br \/>\ndirection to concerned Motor Accident Claims Tribunal to decide the<br \/>\naforesaid claim petition within a period of three months from the<br \/>\ndate of receiving the copy of this order after giving reasonable<br \/>\nopportunity of hearing to the respective parties and respective<br \/>\nparties are entitled to produce the relevant records before the<br \/>\nClaims Tribunal and also entitled to lead oral evidence if any before<br \/>\nthe Claims Tribunal. The Claims Tribunal has to decide the claim<br \/>\npetition on merits in accordance with law.\n<\/p>\n<p>10.\t\tAccordingly,<br \/>\nFirst Appeal is allowed with aforesaid direction. No order as to<br \/>\ncosts.\n<\/p>\n<p>11.\t\tAs<br \/>\nthe First Appeal is allowed to the above extent, Civil Application<br \/>\ndoes not survive.
