Public Prosecutor, Mr.L.R.Pujari and learned advocate,<br \/>\n\tMr.Anip Gandhi,   waive service of rule on behalf of the respondent<br \/>\n\tNos.1 and 2 respectively.\n<\/p>\n<p>The<br \/>\n\tpresent application under Sec.482 of the Code of Criminal Procedure<br \/>\n\thas been filed for quashing and setting aside the impugned judgment<br \/>\n\tand order dated 7.12.2010  passed by the learned Principal Sessions<br \/>\n\tJudge, Mehsana in Criminal Appeal No.91 of 2009 and order dated<br \/>\n\t29.7.2009  passed by the learned JMFC, Mehsana below Exh.3 in<br \/>\n\tCriminal Case No.5635 of 2006.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocate, Mr.Pratik Barot   for the petitioner, learned<br \/>\n\tAddl. Public Prosecutor, Mr.L.R.Pujari for the respondent No.1 and<br \/>\n\tlearned advocate, Mr.Gandhi   for the respondent No.2.\n<\/p>\n<p>It<br \/>\n\tis jointly submitted by the learned Counsel for the parties that the<br \/>\n\tmatter is settled between the parties as per the settlement terms.<br \/>\n\tIt is submitted by learned advocate Mr.Barot for the petitioner that<br \/>\n\tthe petitioner has deposited entire cheque amount as well as<br \/>\n\tRs.10,000\/- towards cost also to the complainant. Learned advocate<br \/>\n\tMr.Gandhi for the respondent No.2 &#8211; complainant submitted that<br \/>\n\tthe complainant has no objection if the permission be granted to<br \/>\n\tcompound the offences.\n<\/p>\n<p>The<br \/>\n\tApex Court in the case of Madan Mohan Abbot Vs. State of Punjab<br \/>\n\treported in (2008)4  Supreme Court Cases page 582 has<br \/>\n\tobserved as under in paras 5 and<br \/>\n\t7 of the judgment:\n<\/p>\n<p>&#8220;5.\tIt is<br \/>\non the basis of this compromise that the application was filed in the<br \/>\nHigh Court for quashing of proceedings which  has been dismissed by<br \/>\nthe impugned order.  We notice from a  reading of the FIR and the<br \/>\nother documents on record that the  dispute was purely a personal one<br \/>\nbetween two contesting  parties and that it arose out of extensive<br \/>\nbusiness dealings  between them and that there was absolutely no<br \/>\npublic policy  involved in the nature of the allegations made against<br \/>\nthe accused.   We are, therefore, of the opinion that no useful<br \/>\npurpose would be served in continuing with the proceedings in the<br \/>\nlight of the compromise and also in the light of the fact that the<br \/>\ncomplainant has, on 11th January 2004,  passed away and the<br \/>\npossibility of a conviction being recorded has thus to be ruled out.&#8221;\n<\/p>\n<p>&#8220;7. We<br \/>\nsee from the impugned order that the learned Judge has confused a<br \/>\ncompounding of an offence with the quashing of  proceedings.  The<br \/>\nouter limit of Rs.250\/- which has led to the dismissal of the<br \/>\napplication is an irrelevant factor in the later case.  We<br \/>\naccordingly allow the appeal and in the peculiar facts of the case,<br \/>\ndirect that  FIR No.155 dated 17th November 2001 P.S. Kotwali,<br \/>\nAmritsar and all proceedings connected therewith shall be deemed to<br \/>\nbe quashed.&#8221;\n<\/p>\n<p>6.<br \/>\n\t Applying the ratio of the aforesaid decision of the Apex Court to<br \/>\n\tthe facts of the present case, I am of the opinion that this<br \/>\n\tCriminal  Revision  Application is required to be allowed and the<br \/>\n\tparties be permitted to compound the offence.\n<\/p>\n<p>7.<br \/>\n\t In the result, this application  is allowed. The impugned judgment<br \/>\n\tand order dated 7.12.2010 passed by the learned Principal Sessions<br \/>\n\tJudge, Mehsana in Criminal Appeal No.91 of 2009 and the order dated<br \/>\n\t29.7.2009  passed by the learned JMFC, Mehsana below Exh.3 in<br \/>\n\tCriminal Case No.5635 of 2006 are hereby quashed and set aside.<br \/>\n\tRule is made absolute to the aforesaid extent.
