DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/08\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tHaving<br \/>\nheard learned advocate for the applicant, learned APP for the<br \/>\nrespondent &#8211; State of Gujarat and considering the facts and<br \/>\ncircumstances of the case, it appears that due to inadvertence, order<br \/>\ndated 28.07.2011 passed in Criminal Misc. Application No.10263 of<br \/>\n2011 is transcribed in  Criminal Misc. Application No.10069 of 2011.<br \/>\nHence, this note for speaking to minutes is allowed in the following<br \/>\nterms:-\n<\/p>\n<p>\tNow,<br \/>\norder dated 28.07.2011 passed in Criminal Misc. Application No.10069<br \/>\nof 2011 be read as under:-\n<\/p>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tI-C.R. No.33\/2011 with Ankleshwar<br \/>\n\tRural Police Station, Bharuch for the offences punishable<br \/>\n\tu\/s. 204, 409, 114, 467 and 120(B)<br \/>\n\tof the Indian Penal Code, u\/s. 3(b) of the Prevention of Damage to<br \/>\n\tPublic Property Act, 1984 and u\/s. 13(1)(c) and (d)(2) of the<br \/>\n\tPrevention of Corruption Act.\n<\/p>\n<p>Learned<br \/>\n\tCounsel appearing for the applicant submits that<br \/>\n\tthe charge-sheet is filed and the co-accused &#8211;  a scrap dealer is<br \/>\n\tenlarged on bail by this Court and hence, by imposing suitable<br \/>\n\tconditions, the applicant may be enlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP Mrs. Manisha L. Shah for the respondent-State.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsels for the parties and perusing the record of<br \/>\n\tthe case and taking into consideration the facts of the case, nature<br \/>\n\tof allegations, role attributed to the applicant, by imposing<br \/>\n\tsuitable conditions, I deem it just and proper to enlarge the<br \/>\n\tapplicant on bail.\n<\/p>\n<p>Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith First Information Report registered as I-C.R. No.33\/2011<br \/>\n\twith Ankleshwar Rural Police Station, Bharuch, on executing a<br \/>\n\tbond of Rs.5,000\/- (Rupees Five Thousand Only) with one surety of<br \/>\n\tthe like amount to the satisfaction of the Trial Court and subject<br \/>\n\tto the conditions that he shall;\n<\/p>\n<p>a)<br \/>\n\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p>b)<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>c)<br \/>\n\tsurrender his passport, if any, to the lower court within a week;\n<\/p>\n<p>d)<br \/>\n\tnot leave the State of Gujarat without prior permission of the<br \/>\n\tSessions Judge concerned;\n<\/p>\n<p>e)<br \/>\n\tmark presence at the concerned Police Station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>f)<br \/>\n\tfurnish the present address of his residence to the Investigating<br \/>\n\tOfficer and also to the Court at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p>The<br \/>\n\tauthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tmade absolute.
