Motor vehicles tax<\/p>\n<p>in respect of the said vehicle was paid for the period up to<\/p>\n<p>31.12.2009. Motor vehicles tax due for the period from 1.1.2010 to<\/p>\n<p>31.3.2010 has not been paid. It is stated that the motor vehicles tax<\/p>\n<p>payable for the current quarter, namely from 1.4.2010 to 30.6.2010<\/p>\n<p>is also due. It is also stated that though the permit is valid and<\/p>\n<p>current, due to mechanical complaints, the petitioner is not presently<\/p>\n<p>operating the stage carriage bus and therefore she is not in a position<\/p>\n<p>to pay the arrears of motor vehicles tax due for the period from<\/p>\n<p>1.1.2010 to 30.6.2010 in lump.       The petitioner also states that<\/p>\n<p>contribution to the Kerala Motor Transport Workers&#8217; Welfare Fund is<\/p>\n<p>also due.   The petitioner submits that though she had submitted<\/p>\n<p>Ext.P2 representation dated 5.4.2010 before the Secretary to<\/p>\n<p>Government, Revenue Department requesting for permission to pay<\/p>\n<p>the motor vehicles tax due for the said period in instalments, orders<\/p>\n<p>have not been passed thereon. In this writ petition, the petitioner<\/p>\n<p><span class=\"hidden_text\">WP(C).No.13626\/2010                  2<\/span><\/p>\n<p>seeks a direction to the first respondent to consider Ext.P2<\/p>\n<p>representation and pass orders thereon within a time limit to be fixed<\/p>\n<p>by this Court. In the alternative, the petitioner seeks a direction to<\/p>\n<p>the second respondent to permit her to pay the arrears of motor<\/p>\n<p>vehicles tax due in respect of her vehicle in four equal monthly<\/p>\n<p>instalments.\n<\/p>\n<p>            2. I heard Sri.I.Dishesh Menon, learned counsel appearing<\/p>\n<p>for the petitioner and Sri.K.P.Pradeep Kumar, learned Government<\/p>\n<p>Pleader appearing for the respondents. The learned counsel for the<\/p>\n<p>petitioner submitted that the petitioner will pay the arrears of motor<\/p>\n<p>vehicles tax due for the period from 1.1.2010 to 30.6.2010 and<\/p>\n<p>arrears of contribution to the Kerala Motor Transport Workers&#8217;<\/p>\n<p>Welfare Fund in three equal monthly instalments, namely on or<\/p>\n<p>before 30.4.2010, 30.5.2010 and 30.6.2010 and that upon the first of<\/p>\n<p>such instalments being paid, she may be permitted to operate the<\/p>\n<p>stage carriage. The learned Government Pleader appearing for the<\/p>\n<p>respondents submitted that if the petitioner remits the instalments in<\/p>\n<p>time, the respondents will permit him to operate the vehicle.<\/p>\n<p>            In the light of the aforesaid submissions, I dispose of this<\/p>\n<p>writ petition with the following directions:\n<\/p>\n<p>            (i) The petitioner shall remit the arrears of motor vehicles<\/p>\n<p><span class=\"hidden_text\">WP(C).No.13626\/2010                   3<\/span><\/p>\n<p>tax payable in respect of the stage carriage bearing registration<\/p>\n<p>No.KL-8 F 5252 for the period from 1.1.2010 to 30.6.2010 along with<\/p>\n<p>interest thereon in three equal monthly instalments. The first of such<\/p>\n<p>instalments shall be paid on or before 30.4.2010, the second on or<\/p>\n<p>before 30.5.2010 and the third on or before 30.6.2010.<\/p>\n<p>              (ii) The petitioner shall also remit the arrears of<\/p>\n<p>contribution to the Kerala Motor Transport Workers&#8217; Welfare Fund<\/p>\n<p>along with interest in three equal monthly instalments, namely on or<\/p>\n<p>before 30.4.2010, 30.5.2010 and 30.6.2010.\n<\/p>\n<p>              (iii) In the event of the petitioner complying with the<\/p>\n<p>aforesaid directions by remitting the instalments in time, the<\/p>\n<p>respondents shall permit the petitioner to operate the stage carriage,<\/p>\n<p>if it is covered by a valid permit.\n<\/p>\n<p>              (iv) If the petitioner does not comply with the aforesaid<\/p>\n<p>conditions, it will be open to the official respondents to take<\/p>\n<p>appropriate steps to realise the arrears of tax and also to prevent the<\/p>\n<p>petitioner from operating the state carriage bus.<\/p>\n<p>                                           P.N.RAVINDRAN<br \/>\n                                                Judge<\/p>\n<p>TKS<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Smt.Rajeena Johnson vs The Revenue Secretary on 23 April, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 13626 of 2010(C) 1.
