No.7425 of 2011\n                                 Chhutaharu Mandal\n                                          Versus\n                                  The State Of Bihar\n                                        -----------\n<\/pre>\n<p>3   20-07-2011              Heard learned counsel for the petitioner as well as<\/p>\n<p>                 learned Additional Public Prosecutor for the state.<\/p>\n<p>                            Petitioner is named in the first information report and<\/p>\n<p>                 allegedly, he poured K.oil on the deceased and lit fire on her<\/p>\n<p>                 body.\n<\/p>\n<p>                            Initially, the case was registered under section-307 of<\/p>\n<p>                 the Indian Penal Code but after death of the informant, the case<\/p>\n<p>                 was converted under section-302 of the Indian Penal Code.<\/p>\n<p>                            The contention of learned counsel for the petitioner is<\/p>\n<p>                 that the deceased was caught in fire accidentally while she was<\/p>\n<p>                 frying pea-nuts but due to previous enmity, she lodged the case<\/p>\n<p>                 against the petitioner and others. To fortify his contention, he<\/p>\n<p>                 drew my attention towards Paragraph-31 of the case diary in<\/p>\n<p>                 which, the fardbeyan of the husband of the deceased has been<\/p>\n<p>                 incorporated by the I.O.\n<\/p>\n<p>                            It appears that after death of the deceased, her<\/p>\n<p>                 husband, namely, Uganand Mandal made a statement before<\/p>\n<p>                 K.Hat Police Station disclosing the accidental death of the<\/p>\n<p>                 deceased but he has stated in the aforesaid fardbeyan that he<\/p>\n<p>                 was not present at the place of occurrence when the occurrence<\/p>\n<p>                 took place. Further, learned counsel for the petitioner tried to<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        satisfy me about the innocence of the petitioner      by placing<\/p>\n<p>        paragraph-42 of the case diary in which, the contents of<\/p>\n<p>        postmortem report of the deceased have been incorporated but I<\/p>\n<p>        am not at all convinced with his submission.\n<\/p>\n<p>                    Accordingly, prayer for bail of the petitioner in<\/p>\n<p>        connection with Forbesganj (Simraha) P.S. Case No. 78 of 2008<\/p>\n<p>        pending in the court of Chief Judicial Magistrate, Araria stands<\/p>\n<p>        rejected.
