' ' '\n\nhg_1vingV\"'bee.r:'heard and reserved and coming\n\non for pr0n=QunC\u00aben2ei1t_0f Judgement this day, BJVIANOHAR\n\n de1iverkl;de\u00abth'e\"ibuc4\u00a7xri\u00a7t1g:\n\n\u00a3~\n\n\n\naccident, the claimant sustained injuries to his body.\n\nImmediately he was shifted to Bowring Lady Curzon \n\nfor treatment and his left leg has been  V'\n\nRajanakunte Police have also registereda-.cas:e  \n\ndriver of the said lorry in Crime No.   \n\nhas contended that he was getting alsalatyhof\nand Rs.50\/-- per day as batt-a..and,t1e  abo1jt\"20l years.\nSince, the vehicle is covered it by  sought for\n\ncompensation from 1_I:f1t':i_SV(f2C()1'i(3l responder;-t:I.nsurer.\n\n3. Pursuant  Commissioner for\nWorkmen's  of the vehicle remained\nexparte. The  \ufb01led objections\ndenying  in the claim petition and also\n\ncontended. 'tit-.i:s\"~--for the claimant to prove that he was a\n\nI;\u00bb.yvorkznanx\"tinderu.thep'g::.second respondent. Further contended\n\nthat -in  \"accident, one Manjunath also died and his\n\nlegal'ijrepresenltatives have also filed a claim petition\n\nan  contending that he was working as a cieaner of\n\n\/5N\n\n\n\nthe said vehicle. Hence, the claimant is not entitled for___any\n\ncompensation. However, admitted that the said \n\ncovered by insurance and sought for dismissal  \"\n\npetition as against the second respondent\u00bbi\u00bbn.surer.itit  '4 \n\n4. On the basis of the p1ead--in'gs oi\"  the\n\nCommissioner for Workr,.nen's ,-\"--'C.ompe_nsatioiiA. V\/'framed\n\nnecessary issues.\n\n5. in order to    examined\nhimseif as P.W.1   doictiments as EXP. 1 to\nEx.P.7 8: R7  the Doctor who has treated\nhim as P.W.2    documents as Ex.P.8 to\n   insurer has not examined any\n\nwitnesses... _ iioweveix. the Insurer has cross--examined P.W.1\n\n   it \n\n'  in  evidence has stated that he was Working as\n\nthe offending vehicle. He has stated that on\n\n\/5\/\n\n\n\nl6--7--2005, after loading the sand to the said lorry and while\n\nproceeding towards Bangalore from Doddaballapur, \n\nlorry met with an accident, due to the rash and\n\ndriving of the lorry by its driver and he isupstained\"'i11juri_e.s.7..\n\nSince. he is a Workman under the Worl;;rnen\"s Compensation:\"\n\nAct, he is entitled for compensatioi~1..p illlie  this\nevidence has deposed that due top..the-lithe claimant\nhas suffered injuries to his left  his\nleft leg has to be  on\n27-62006, the \" there is swelling and\ntenderness 'left lower limb and left\nhip region.   without crutches or\nanybody's help.  the treatment for more than\n7%.:-4\"\u00a2l'aysA_ _thelHD\"oc'tor has assessed the disability of\n\n80%i'theVAfunctionaladisability is assessed as 100%, in View of\n\n  amputation  left leg. He cannot Work as a coolie.\n\n  the basis of the evidence let in by the parties, the\n\n for Workmen's Compensation held that the\n\nW\n\n\n\n7\nclaimant is a Workman within the meaning of Workrnens\nCompensation Act and awarded compensation taking into\n\nconsideration the age and saiary drawn by the ciaimantpas\n\nRs.3,000\/-- pm. Taking 60% of the salary V.\n\nrelevant factor, the Commissioner has awarded cor'npen'sVation-- \n\nof R.s.3,81,222\/~ (1800 x 211.79) and azsa awarded;interestiwatn'.\n\nthe rate of 12% p.a. from the date ofelaini. 'petitions.  \" ' V\n8. The appellant being aggrievedby the  by\nthe Commissioner for Wor1\u00a7'1'nen'shndtjornperisationqi preferred\n\nthis appeal.\n\n9. Sri.D.S.S-ririhar,-- : appearing for the\nappellant contend\"ed_v'that tiviedeompensation awarded by the\nCornniissionerri'-iris\"i-epontrarfto the Workmen's Compensation\n\nAct.   the:vi_jDoetor has deposed in his cross-\n\n iexamination  claimant has suffered disability of 80%,\n\n has taken the disability at 100% and\n\n _'awarsd'e.d'eonipensation, which is contrary to law. Further, he\n\n\/9\n\n\n\naiso contended that the rate of interest at 12% p.a. awarded\n\nby the Commissioner is aiso contrary to the law laid \n\nthe Hon'b1e Supreme Court.\n\n10. On the other hand, Sn'.Suresh 'learned \n\nappearing for the first responder:n\"t..p cohntertidedi,  the\nCommissioner, taking into the\"\"'funetiona1\ndisability of the claimant and\ufb02awlso  factor\nhas awarded just   the same does\nnot require any  Court and sought\nfor dismissal {of  '   i I\n\n11. We have   through the arguments\n\naddressedthe Iearriedcoiinsel for the parties, perused the\n\nawards   _ the Commissioner for Workmen's\n\n _Compensation'Van\"d  oral and documentary evidence of the\n\n'p_arti'es .\n\nAw\n\n\n\n12. The only point that arises for consideration in ___this\n\nappeal is as to whether the compensation awarded \n\nCommissioner is in accordance with the  '\n\nCompensation Act?   \n\n13. It is not in dispute that v'd.n\"e~,_Mto the ' \"that\noccurred on 16\u00bb? -2005 at  the claimant\nhas sustained injuries. The i5oli_c'e  a_i;soV\"_:e'gistered a case\n\nagainst the driver   the FIR, the\nclaimant is ShOVV\u20ac'riH  and he was\nWorking as  IV-flence, it is clear that\nthe claimant  a  loriy which belongs to\nthe second_1fes}ao'ndentV'VheAiiein':'and the accident has taken\n\nplace' the icours'e\"o'f\"emp1oyment and he is entitled to\n\nseek\"cton;pensation' izlnder the Workmen's Compensation Act.\n\njifi'-liiough   has claimed that he is aged about 20\n\n on date of accident, the Doctor in his medical\n\n reieariy mentioned the age of the claimant as 28\n\nA\"\n\n\n\nE0\n\nyears. Further, the claimant has contended that the second\n\nrespondent was paying a salary of Rs.3.000\/-- \n\nRs.50\/--~ per day as batta, the Commissioner  V'\n\nconsideration 60% of the salary of Rs..&lt;3;0-Q0\/~-lg&#039; it\n\ncompensation by applying the relevant  it\n\n14. The Doctor in his evidence has  to the\ninjuries to the left leg and  &#039;gangrene, his\nleft leg had to be  stated that on\nclinical examination&#039;::.&#039;on&quot; that there was\nswelling and  leg and the hip\nregion and  or any other person,\nhe cannot Astandl\u00e9lor hoilgh the Doctor has assessed\nthe 80%, the functional disability was\n\nassessedypat&#039; x}  cannot do the work of a coolie. The\n\n lcletimantlbeingaiitililliterate person, except the coolie work, he\n\n&quot;c.&#039;a:14:iot do anygother work. Hence, the compensation awarded\n\nV   the --_CloIr_itnissioner taking into consideration the functional\n\nXM\n\n\n\ndisability of 100% is in accordance with law. There  no\n\ninfirmity or illegality in the award passed by\n\nCommissioner for Workmen&#039;s Compensation  V&#039;\n\naccordance with the Workmen&#039;s Compensation ;&#039;Act.4&quot;   i V&#039;  \n\n15. Further, the contention of   the\nappellant that the rate of in;terestp..aVu:aifdedi.at  pfa. from\nthe date of claim petition is  reported\nin 2009 AIR scw,    ORIENTAL\nINSURANCE   MOHD. NASIR AND\nOTHERS  &quot;1;&#039;ne&quot;&#039;Hon&#039;ble Supreme Court\nhas clearly held that   entitled for the interest at\nthe rate of V7_.v5%&#039;C&#039;pi.a:; ftornA&quot;the--&quot;CCVdate of claini petition till the\nda_te&quot;o.f pavs_siingT.:ttieA.avstardand thereafter 12% p.a. till the date\n\nof deposit;_ &#039;I-tIen.ce\u00bb,4&quot;pass the following:\n\nORDER\n<\/pre>\n<p>  \ufb01led by the appellant is allowed in part. The<\/p>\n<p>V&#8221;&#8216;\u00bbC.&#8217;e.ompene-Zation awarded by the Commissioner for Workmen&#8217;s<\/p>\n<p>\/iw<\/p>\n<p>Compensation is con\ufb01rmed.
