BHAGWANPUR,\n                     DISTRICT-VAISHALI.                         ....PETITIONER.\n                                              Versus\n                   THE STATE OF BIHAR.                  .......OPPOSITE PARTY.\n                                            -----------\n<\/pre>\n<p>03.   28.04.2011            Rule confined to question of sentence only.<\/p>\n<p>                               Learned A.P.P. waives notice on behalf of the State.<\/p>\n<p>                               With the consent of the parties the present revision<\/p>\n<p>                   application is being disposed of at this stage itself.<\/p>\n<p>                               Petitioner herein was put on trial vide T.R. No. 155<\/p>\n<p>                   of 2000 for the charge(s) punishable under Section 3(a) of the<\/p>\n<p>                   R.P. (U.P.) Act. Eight witnesses were examined besides<\/p>\n<p>                   exhibiting documents to prove the charge(s). On a consideration<\/p>\n<p>                   of the matter, learned trial court (Judicial Magistrate First Class<\/p>\n<p>                   Kiul) found the petitioner guilty under the aforesaid charge and<\/p>\n<p>                   sentence to under go R.I. for 1 year. Aggrieved by the aforesaid<\/p>\n<p>                   judgment and order, the petitioner preferred appeal no. 167 of<\/p>\n<p>                   2000. Learned appellant court confirmed the findings of guilt<\/p>\n<p>                   and dismissed the appeal.\n<\/p>\n<p>                               It is submitted that at the time of conviction<\/p>\n<p>                   petitioner was found aged about 60 years. Occurrence, as per<\/p>\n<p>                   prosecution case, had taken place on 26.12.1987. The trial of the<\/p>\n<p>                   petitioner consumed closed to 13 years. Referring to judgment, it<\/p>\n<p>                   is submitted that there is no past conviction recorded against<\/p>\n<p>                   him. It is thus submitted that the petitioner deserves lesser<\/p>\n<p>                   quantum of sentence for the proven charge(s).<\/p>\n<p>                               Learned A.P.P. on the other hand, submits that there<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>            have been concurrent findings of guilt recorded by the court<\/p>\n<p>            below, which cannot be said to be perverse and\/or illegal.<\/p>\n<p>                         I have heard the submissions made on behalf of the<\/p>\n<p>            parties. Learned counsel for the petitioner is right in his<\/p>\n<p>            submission that the trial court consumed more than 13 years.<\/p>\n<p>            Fighting criminal litigation for a long time is a shade of<\/p>\n<p>            punishment as during these periods the litigant has to suffer the<\/p>\n<p>            rigorous\/ordeal of trial and also to face several excruciating<\/p>\n<p>            circumstances having telling effects on the economical as well as<\/p>\n<p>            mental condition of the litigant.        He is further right in his<\/p>\n<p>            submission that no previous conviction was found and recorded.<\/p>\n<p>            It appears that at the time of recording conviction he was<\/p>\n<p>            assessed 60 years of age. Such assessment was made in the year<\/p>\n<p>            2000. We are in the year 2011. Obviously petitioner is over 70<\/p>\n<p>            years of age. This Court is, thus, satisfied that a lesser quantum<\/p>\n<p>            of sentence, in the facts and circumstances of the case, would<\/p>\n<p>            subserve the ends of justice.\n<\/p>\n<p>                         Accordingly, while upholding the judgment and<\/p>\n<p>            order of conviction passed by learned trial court and duly<\/p>\n<p>            affirmed by the lower appellate court the sentence awarded<\/p>\n<p>            thereunder    is   reduced   to   R.I.    for   04   months.     Other<\/p>\n<p>            part(s)\/condition(s) of sentence, if any, shall remain intact.<\/p>\n<p>                         With this modification in sentence only, the<\/p>\n<p>            application is dismissed.\n<\/p>\n<\/p>\n<pre>Devendra\/                                               ( K.K.
