In this context it is<br \/>\nnecessary to note that according to the respondent, his service was<br \/>\nallegedly terminated with effect from 15.1.2002. Thus, when the<br \/>\npetitioner&#8217;s advocate relied on the statement in the oral evidence<br \/>\nmade by the respondent workman that he had not gone to report for<br \/>\nwork after 13.2.2002, the gap between 15.1.2002 to 13.2.2002 remains<br \/>\nto be explained by the employer. Be that as it may. At this stage it<br \/>\nis not relevant since the learned advocate for the petitioner has<br \/>\nsubmitted that the petitioner is ready and willing to allow the<br \/>\nrespondent to report for work.\n<\/p>\n<p> \tIt<br \/>\nis also claimed that since the petitioner&#8217;s advocate did not remain<br \/>\npresent during the proceedings after particular stage, the subsequent<br \/>\nproceedings were held ex-parte. One of the contentions raised by the<br \/>\npetitioner&#8217;s advocate is that in the entire award the labour Court<br \/>\nhas not recorded any finding about the provisions of law which,<br \/>\naccording to the conclusion of the Court, were violated or can be<br \/>\nsaid to have been violated by the petitioner company.\n<\/p>\n<p>3.<br \/>\nHaving regard to the said contentions the office is directed to issue<br \/>\nNotice returnable on 16.3.2011.\n<\/p>\n<p>4.<br \/>\nIn the meanwhile the petitioner will reinstate the respondent. The<br \/>\nwritten intimation by the petitioner company to the respondent by<br \/>\nR.P.A.D. shall be sent at the address available on record of the<br \/>\ncompany as well as the address mentioned in the title of the award<br \/>\nand if the person was represented by Union then, at the Union&#8217;s<br \/>\naddress as well with specifically mentioned the name and designation<br \/>\nof the authority, who should be contacted by the respondent workman<br \/>\nwhile report for work.\n<\/p>\n<p>5.<br \/>\nIn the meanwhile by way of ad-interim relief the direction regarding<br \/>\npayment of backwages will remain stayed until next date of hearing.\n<\/p>\n<p>6.<br \/>\nMr. Chaudhary, learned advocate appearing for the respondent has<br \/>\nsubmitted while opposing the request for stay against the direction<br \/>\nfor payment of backwages, submitted that respondent will report for<br \/>\nwork on or before 7.3.2011.\n<\/p>\n<p>(K.M.THAKER,J.)<\/p>\n<p>Suresh*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Neral vs Shashikant on 1 March, 2011 Author: K.M.Thaker,&amp;Nbsp;
