Ms.Krina Calla, learned AGP waives service of notice of Rule on<br \/>\nbehalf of respondents No.1 and 2 and Shri Bipin Jasani, learned<br \/>\nadvocate  waives service of notice of Rule on behalf of respondent<br \/>\nNo.3.  With the consent of the learned advocates appearing on behalf<br \/>\nof the respective parties, the petition is taken up for final hearing<br \/>\ntoday.\n<\/p>\n<p>2.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\npetitioner has prayed for an appropriate writ, order or direction,<br \/>\nquashing and setting aside the impugned order 8\/11.12.2008 Annexure<br \/>\n A  to the ptition passed by the Joint Director of Eduction<br \/>\n(10+2), State of Gujarat, Gandhinagar.\n<\/p>\n<p>3.\tNumber<br \/>\nof submissions have been made on behalf of the respective parties on<br \/>\nmerits.  However, in view of the fact that the impugned order is<br \/>\npassed without hearing the petitioner and considering the<br \/>\ncontemporaneous question raised, this Court proposes to remand the<br \/>\nmatter to the Joint Director of Education who has passed the impugned<br \/>\norder. This Court is not further considering the other larger<br \/>\nquestion on merits.\n<\/p>\n<p>4.\tMs.Krina<br \/>\nCalla, learned AGP has submitted that technically it cannot be said<br \/>\nthat the impugned order is in breach of principle of natural justice<br \/>\nas the opportunity was given but nobody remained present on behalf of<br \/>\nthe petitioner.   Without further entering into the said question, in<br \/>\nthe facts and circumstances of the case and the legal issues, this<br \/>\nCourt is still of the opinion that, let the impugned order be quashed<br \/>\nand set aside and the matter be remanded to the Joint Director of<br \/>\nEducation for taking an appropriate decision in accordance with law<br \/>\nand on merits after hearing the petitioner as well as the respondent<br \/>\nNo.3.\n<\/p>\n<p>5.\tFor<br \/>\nthe reasons stated above and without further expressing any opinion<br \/>\non merits, the impugned order dated 8\/11.12.2008  passed by the Joint<br \/>\nDirector of Eduction (10+2) is hereby quashed and set aside and the<br \/>\nmatter is remanded to the  Commissioner of Schools and Mid Day Meals,<br \/>\n  who has passed the impugned order  for deciding the same afresh in<br \/>\naccordance with law and on merits and after giving an opportunity to<br \/>\nthe petitioner as well as respondent No.3.  All the contentions which<br \/>\nare available to the respective parties are kept open.  It is agreed<br \/>\nbetween the parties that the representatives of the petitioner as<br \/>\nwell as the respondent No.3 shall remain present before the<br \/>\nrespondent No.2   Commissioner of Schools and Mid-day Meals, State<br \/>\nof Gujarat on 9.2.2009 at  1.00 p.m. and make their submissions and<br \/>\nthereafter the  respondent No.2  to pass an appropriate order in<br \/>\naccordance with law and on merits and communicate the outcome to the<br \/>\nsame to the respective parties accordingly.   Rule is made absolute<br \/>\naccordingly.  In the facts and circumstances of the case, there shall<br \/>\nbe no order as to costs. \tDirect service is permitted.\n<\/p>\n<p>(<br \/>\nM.R.
