S.J.MUKHOPADHAYA)<\/p>\n<p>\tPursuant<br \/>\nto the Court&#8217;s order, an affidavit has been filed by the respondents.<br \/>\nMr.P.Paneervel, Principal Secretary, Revenue Department who is<br \/>\npresent has also assisted the Court.\n<\/p>\n<p>\tIt<br \/>\nappears that with a view to cut-short the lengthy procedure, the<br \/>\nauthorities have allocated area of about 200 sq.meters to Agriculture<br \/>\nProduce Market Committee, Songadh for the purpose of settling 39<br \/>\nvegetables vendors. However, we observe that, that was not the<br \/>\nintention of the Court. The Court never wanted settlement of one or<br \/>\nother particular vendors.\n<\/p>\n<p>\tFrom<br \/>\nthe record, it will be evident that the local &#8216;adivadis&#8217; (Scheduled<br \/>\nTribes people) who are small vendors or growing vegetables, they sale<br \/>\nvegetables by the side of the road. They come daily, sale their<br \/>\nvegetables and go back. They do not have any stall over there. The<br \/>\nCourt intended to have some area which should be covered by Market<br \/>\nCommittee with a roof to protect them from sun and rain, where the<br \/>\nfarmers or the tribes and small vegetables vendors can come and sale<br \/>\ntheir vegetables without any claim on any area and will go back, on<br \/>\nfirst come first basis. Every day such vendors can be allotted to<br \/>\noccupy place on the floor marked for them and the Market Committee<br \/>\nmay charge nominal fee of Re.1\/- to Rs.5\/- per day from them.\n<\/p>\n<p>\tMr.Paneervel,<br \/>\nPrincipal Secretary, Revenue Department submits that he will<br \/>\nreconsider the matter and if necessary, the allotment letters may be<br \/>\nreviewed and may be cancelled to take steps for allotment in<br \/>\naccordance with the observations of the Court.\n<\/p>\n<p>\tWe<br \/>\naccordingly allow the respondents to do needful as per discussion and<br \/>\nobservations made above.\n<\/p>\n<p>\tThis<br \/>\norder shall not stand in the way of allotment of some other place for<br \/>\nScheduled Tribes people and other small vendors, with any condition.\n<\/p>\n<p>\tPost<br \/>\nthe matter on 20th June 2011 (on the top of the list).\n<\/p>\n<p>\tUntil<br \/>\nfurther order, the Market Committee will not allot the area allotted<br \/>\nby the State to any individual vendor, as the Court may direct as to<br \/>\nhow such area can be divided and may be allotted in favour of the<br \/>\nretail vegetables vendors or distinct vendors.\n<\/p>\n<p>(S.J.Mukhopadhaya,<br \/>\nCJ.)<\/p>\n<p>(J.B.Pardiwala,<br \/>\nJ.)<\/p>\n<p>\/moin<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Jashuben vs State on 27 April, 2011 Author: Mr.S.J.Mukhopadhaya,&amp;Nbsp;Mr.Justice J.B.Pardiwala,&amp;Nbsp;
