Justice K.P.BALACHANDRAN\n\n Dated :14\/10\/2008\n\n O R D E R\n         J.B.Koshy &amp; K.P.Balachandran, JJ.\n         ---------------------------------\n                W.A.No.2042 of 2008\n         ---------------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>Koshy, J.\n<\/p>\n<p>\n    The   second  petitioner   was   appointed  as<\/p>\n<p>Principal in charge. But that was not approved by<\/p>\n<p>the  Deputy  Director   (Exhibit  P7).  An   appeal<\/p>\n<p>(Exhibit P8) was filed against Exhibit P7 order.<\/p>\n<p>It  is   pending   consideration  by   the   second<\/p>\n<p>respondent.   In the meanwhile, the salary bill<\/p>\n<p>submitted for the month     of September 2008 was<\/p>\n<p>rejected on the ground that appointment of the<\/p>\n<p>second petitioner as Principal in charge was not<\/p>\n<p>approved. But, the teachers and staff in the Higher<\/p>\n<p>Secondary School cannot be denied salary. In the<\/p>\n<p>above circumstances, we direct the third respondent<\/p>\n<p>to pass the salary bill of the teachers and at the<\/p>\n<p>maximum  charge   allowance  due   to  the   second<\/p>\n<p>petitioner alone can be withheld, pending disposal<\/p>\n<p>of the appeal. The second respondent should see to<\/p>\n<p><span class=\"hidden_text\">WA 2042\/08                2<\/span><\/p>\n<p>it that salary of the teachers and staff are not<\/p>\n<p>delayed because of the alleged non approval of<\/p>\n<p>appointment of the Principal in charge.
